A BILL FOR AN ACT

 

 

relating to tuition waivers.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:



     SECTION 1.  The legislature finds that the authority of granting tuition waivers by the University of Hawaii system, including its community colleges, is a matter of statewide concern.

     The purpose of this Act is to require the University of Hawaii system and its community colleges to waive tuition for the dependent children of disabled veterans, or active or reserve members of the armed forces who were killed in action, subject to certain requirements.

     SECTION 2.  Chapter 304A, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§304A-     Tuition waivers; children of eligible veterans.  (a)  The University of Hawaii, including its community colleges, shall waive tuition for any qualified student who demonstrates financial need and is a dependent child of:

     (1)  A disabled veteran;

     (2)  An eligible veteran or national guard member who was killed in action while engaged in active federal military or naval service; or

     (3)  A purple heart medal recipient, alive or deceased, awarded in 2001 or later;

who has been domiciled in the State for at least five years or was domiciled in the State for at least five years at the time of their death.

     (b)  For purposes of this section:

     "Dependent child" includes an adopted child or stepchild that has been a dependent of a veteran, national guard member, or purple heart recipient described in subsection (a) for at least five years prior to their application for a tuition waiver at a University of Hawaii campus.

     "Disabled veteran" means a veteran who is determined by the United States Department of Veterans Affairs to have a service-connected one hundred per cent disability rating for compensation or a service-connected disability rating of one hundred per cent due to the physical or psychological injuries received while on duty with the armed forces of the United States.

     "Eligible veteran or national guard member" means a veteran or national guard member who was an active or reserve member of the United states military or naval forces, or a national guard member called to active duty, who served in the active federal service under title 10 or title 32 of the United States Code, in a war or conflict fought on foreign soil, in international waters, or in another location in support of those serving on foreign soil or in international waters.

     "Qualified student" means a student under the age of twenty-four.

     (c)  The board of regents may adopt rules pursuant to chapter 91 to implement this section."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
