A BILL FOR AN ACT

 

 

relating to land use.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 6E, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part   .  valley of historic and cultural significance

     §6E-A  Declaration of policy.  In accord with section 226-12, the people of Hawaii have a substantial interest in the preservation of views and vistas to enhance the visual and aesthetic enjoyment of the State.  There is a compelling state interest in safeguarding valleys that provide special historic, cultural, and visual value to the State.

     §6E-B  Valley of historic and cultural significance; designation.  (a)  Any valley that has significant historic, cultural, and visual value to the State may be designated as a valley of historic and cultural significance.

     (b)  A valley of historic and cultural significance shall be designated through enactment of legislation.  Once designated as a valley of historic and cultural significance, the uses allowed on the land shall be restricted pursuant to section 6E-C.

     §6E-C  Restrictions.  (a)  Any structure that is proposed to be constructed in a valley of historic and cultural significance shall be set back not less than one hundred feet from the valley rim and shall not be visible by a person on the valley floor.

     (b)  For the purposes of this section, "valley rim" means the boundary of a valley wall that is          feet above the lowest point of the valley floor.

     §6E-D  Designated valleys.  The following valleys are hereby designated as valleys of historic and cultural significance:

     (1)  Hanalei valley, on the island of Kauai; and

     (2)  Waipio valley, on the island of Hawaii."

     SECTION 2.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 3.  This Act shall take effect upon its approval.
