A BILL FOR AN ACT

 

 

relating to mooring rate increases.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  On December 11, 2009, the board of land and natural resources amended its administrative rules to increase mooring rates for all recreational harbors.  The legislature finds that the mooring rate increase will impose a hardship on small commercial charter boats that support tourism, as well as small commercial fishing boats that sell seafood to local restaurants.  The legislature also finds that commercial businesses are experiencing a significant downturn in business due to a number of reasons, including a drop in visitor arrivals, increased fuel costs, low consumer confidence, and decreased discretionary spending.

     The purpose of this Act is to suspend the increase in mooring rates for all recreational harbors until:

     (1)  The legislature approves the increase; or

     (2)  January 1, 2013,

whichever occurs first.

     SECTION 2.  Any mooring rate increases for all recreational harbors adopted by the board of land and natural resources on December 11, 2009, shall be suspended.  Any mooring rates in effect on December 10, 2009 shall become effective from the effective date of this Act; provided that any rate increases on mooring fees adopted by the board of land and natural resources on December 11, 2009, shall become effective upon the earlier of:

     (1)  Approval of the rate increases by a concurrent resolution adopted by a majority vote of the members in both houses of the legislature; or

     (2)  January 1, 2013.

     SECTION 3.  The auditor shall review the economic impact on commercial permit holders by the proposed mooring rate increases adopted by the board of land and natural resources on December 11, 2009, and recommend graduated increases that will not adversely affect the permanent mooring community.

     The auditor shall submit any findings and recommendations to the legislature no later than twenty days prior to the convening of the regular session of 2011.

     SECTION 4.  This Act shall take effect upon its approval.
