A BILL FOR AN ACT

 

 

relating to legislative SERVICE agencies.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 21E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§21E-     Legislative service agency director vacancies.  (a)  Upon the vacancy of a legislative service agency director position, the committee shall convene meetings within thirty days of the vacancy to seek and examine candidates to fill the vacancy.

     (b)  The committee shall hold a public hearing on selected candidates and make a joint recommendation to each respective chamber for consideration within one hundred twenty days of any legislative service agency director vacancy; provided that applicant pool data and committee deliberations separate from the public hearing shall be confidential and not subject to disclosure pursuant to chapter 92F.

     (c)  Each chamber shall determine by rule the process it will use to adopt or not adopt the joint recommendation, any other deadlines for acting upon a recommendation, whether a person recommended by the committee to serve as a legislative service agency director may serve in an interim or acting capacity if both houses do not adopt the recommendation, and other necessary considerations."

     SECTION 2.  Section 21E-2, Hawaii Revised Statutes, is amended by amending its title and subsections (a) and (b) to read as follows:

     "[[]§21E-2[]]  Establishment of the joint legislative management committee; members; terms; vacancies.  (a)  There is established within the legislature a bipartisan joint legislative management committee to [supervise, develop policy, and coordinate activities for all] seek and examine candidates, and submit a recommendation for a candidate, to fill a vacancy in any legislative service agency [staff services.] director position.

     (b)  The committee shall consist of [ten] eight members:  [five] four shall be representatives appointed by the speaker of the house of representatives, [including the chairperson of the house committee on legislative management and at least one member of the minority party], and [five] four shall be senators appointed by the president of the senate, [including the chairperson of the senate committee on legislative management and at least one member of the minority party].  The appointing authority of each house shall make and announce the appointment or reappointment of members of the committee no later than fifteen days after the convening of the first regular session of each legislature.  [The chairpersons of the house and senate legislative management committees] One of the members appointed by the speaker of the house of representatives and one of the members appointed by the president of the senate shall serve as co-chairs of the joint legislative management committee."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
