A BILL FOR AN ACT

 

 

proposing an amendment to the hawaii constitution to allow construction of a nuclear power plant or disposal of RADIOACTIVE material in the state without prior legislative approval.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State's power grid would benefit from more diverse energy sources.  Meeting the State's need for reliable, affordable, and sustainable power requires the State to have access to the full spectrum of available energy sources, including nuclear energy.

     The legislature recognizes that article XI, section 8 of the Constitution of the State of Hawaii makes it difficult for the legislature to approve the construction and use of nuclear power plants.

     Accordingly, the purpose of this Act is to propose an amendment to Hawaii's constitution to make nuclear energy more accessible to the State.

    SECTION 2.  Article XI, section 8, of the Constitution of the State of Hawaii is repealed.

["NUCLEAR ENERGY

    SECTION 8.  No nuclear fission power plant shall be constructed or radioactive material disposed of in the State without the prior approval by a two-thirds vote in each house of the legislature."]

     SECTION 3.  The question to be printed on the ballot shall be as follows:

     "Shall the Constitution of the State of Hawaii be amended to allow the legislature to approve the construction of nuclear fission power plants without requiring prior approval by a two-thirds vote in each house of the legislature?"

     SECTION 4.  Constitutional material to be repealed is bracketed and stricken.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
