A BILL FOR AN ACT

 

 

relating to employment security.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 383, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§383-     Optional total unemployment rate trigger; extended benefits.  (a)  There shall be a "state 'on' indicator" for this State with respect to weeks of unemployment until the week ending four weeks prior to the last week of unemployment for which one hundred per cent federal sharing is available under federal law, under the following conditions:

     (1)  The average rate of total unemployment (seasonally adjusted), as determined by the United States Secretary of Labor, for the period consisting of the most recent three months for which data for all states are published before the close of such week equals or exceeds:

         (A)  Six and one-half per cent, for an extended benefit period of thirteen weeks; or

         (B)  Eight per cent, for an extended benefit period of twenty weeks;

          and

     (2)  The average rate of total unemployment in this State (seasonally adjusted), as determined by the United States Secretary of Labor, for the three-month period referred to in paragraph (1) equals or exceeds one hundred ten per cent of such average for either or both of the corresponding three month periods ending in the preceding two calendar years.

     (b)  There shall be a "state 'off' indicator" for this State for a week if, for the period consisting of such week and the immediately preceding twelve weeks, subsection (a) was not satisfied."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
