A BILL FOR AN ACT
relating to the hawaii prepaid health care act'S premium supplementation TRUST fund.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The Hawaii Prepaid Health Care Act's premium supplementation trust fund was established in section 393-41, Hawaii Revised Statutes, in 1974 to help defray the cost of providing health care benefits for small business employers with less than eight employees entitled to and covered under the Act. To qualify for premium supplementation, small business employers must meet the department of labor and industrial relations' criteria and file a claim. While the premium supplementation trust fund's two main sources of income are moneys appropriated by the State and fines and penalties collected under the Hawaii Prepaid Health Care Act, the fund's balance has historically been nominal. Further, employers are required to establish their entitlement to reimbursement from the premium supplementation trust fund.
The purpose of this Act is to:
(1) Increase the appropriation to the premium supplementation trust fund; and
(2) Establish one full-time equivalent (1.0 FTE) position at a maximum annual salary of $70,000 to conduct small business employer outreach and to provide premium supplementation trust fund application assistance in furtherance of the director of labor and industrial relations' responsibilities to administer the fund, pursuant to section 393-31, Hawaii Revised Statutes.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2022-2023 to be deposited into the premium supplementation trust fund.
The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this Act.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $70,000 or so much thereof as may be necessary for fiscal year 2022-2023 for one full-time equivalent (1.00 FTE) permanent position to conduct small business employer outreach and to provide assistance with applications for premium supplementation in furtherance of fund administration responsibilities pursuant to section 393-31, Hawaii Revised Statutes.
The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this Act.
SECTION 4. This Act shall take effect on July 1, 2022.
