A BILL FOR AN ACT
relating to skilled nursing facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 209E, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:
"Part . SKILLED NURSING FACILITIES
§209E-A Skilled nursing facilities; equal benefits; location outside enterprise zone; when. Each skilled nursing facility located outside a designated enterprise zone that:
(1) Begins operation as a new facility; or
(2) Expands existing operations as a skilled nursing facility,
on January 1, 2010, or thereafter shall be deemed a qualified business operating within an enterprise zone for the purpose of applying for and receiving all benefits provided under this chapter."
SECTION 2. Section 209E-2, Hawaii Revised Statutes, is amended as follows:
1. By adding a new definition to be appropriately inserted and to read:
""Skilled nursing facility" has the same meaning as defined in Section 1819(a) of the Social Security Act, as amended (42 U.S.C. 1395i-3)."
2. By amending the definition of "medical and health care services" to read:
""Medical and health care
services" means medical research, clinical trials, [and]
telemedicine, and services provided in a skilled nursing facility, but does
not include any other routine medical treatment or services."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
