A BILL FOR AN ACT

 

 

relating to infrastructure.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  The legislature finds that sea level rise, shoreline recession, and beach loss are threatening Hawaii's coastal infrastructure.  Scientists project a sea level rise of one foot by 2050 and three feet by 2100.  Sea level rise increases the frequency and severity of coastal flooding due to extreme tides, high waves, and storms.  Sea level rise also raises the groundwater table leading to increased flooding, poor drainage, and weather damage to coastal areas.  Hawaii will experience more coastal erosion and damage to coastal infrastructure as the sea level rises.

     Studies conducted by the United States Geological Survey and University of Hawaii found that seventy per cent of Hawaii's beaches are eroding and over thirteen miles of Hawaii beaches are completely lost due to erosion.  Coastal erosion exacerbates coastal flooding and inundation leading to the permanent land loss.  Eventually, sea level rise and coastal erosion will permanently inundate Hawaii's coastal areas and public infrastructure.

     The purpose of this Act is to appropriate funds to relocate or develop public infrastructure inland.

PART II

     SECTION 2.  The director of finance is authorized to issue general obligation bonds in the sum of $         or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2017-2018 for land acquisition, plans, design, and construction for realigning coastal highways or developing new highways inland.

     SECTION 3.  The director of finance is authorized to issue general obligation bonds in the sum of $         or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2017-2018 for land acquisition, plans, design, and construction for relocating state airports inland.

     SECTION 4.  The director of finance is authorized to issue general obligation bonds in the sum of $         or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2017-2018 for plans, design, and construction for preparing state harbors for sea level rise.

     SECTION 5.  The sums appropriated for the respective capital projects set forth in this part shall be expended by the department of transportation for the purposes of this Act.

PART III

     SECTION 6.  The director of finance is authorized to issue general obligation bonds in the sum of $         or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2017-2018 for land acquisition, plans, design, and construction for the counties to improve or develop new sewer, water, and electrical infrastructure that can withstand increased flooding and sea level rise as follows:

SECTION 7.  The sums appropriated for the respective capital improvement projects set forth in this part shall be expended by the respective counties for the purposes of this Act.

PART IV

     SECTION 8.  The appropriations made for the capital improvement projects authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriations are made; provided that all moneys from the appropriations unencumbered as of June 30, 2020, shall lapse as of that date.

     SECTION 9.  This Act shall take effect on July 1, 2017.
