BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Title 47 of the Official Code of Georgia Annotated, relating to retirement
and pensions, so as to revise, modernize, and correct errors or omissions in
said title in furtherance of the work of the Code Revision Commission; to repeal
portions of said title, or Acts in amendment thereof, which have become
obsolete, have been declared to be unconstitutional, or have been preempted or
superseded by subsequent laws; to provide for effect in event of conflicts; to
provide an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Title
47 of the Official Code of Georgia Annotated, relating to retirement and
pensions, is amended in:
(1) Code Section 47-2-317, relating to membership in the retirement system of officers and employees of the Georgia Agrirama Development Authority, by repealing and reserving said obsolete Code section.
(2) Code Section 47-23-43, relating to the preservation of prior rights under said Code section by certain attorneys employed by the Office of Legislative Counsel or the Department of Law, by revising said Code section as follows:
(1) Code Section 47-2-317, relating to membership in the retirement system of officers and employees of the Georgia Agrirama Development Authority, by repealing and reserving said obsolete Code section.
(2) Code Section 47-23-43, relating to the preservation of prior rights under said Code section by certain attorneys employed by the Office of Legislative Counsel or the Department of Law, by revising said Code section as follows:
"47-23-43.
Any
person employed pursuant to Code Section 28-4-3 or 45-15-31
who
was subject to the
former
provisions of this Code section
as such
existed on June 30, 2005, shall retain all
rights and obligations as
exist
existed
on that day. Such persons shall be subject to all provisions of this chapter
applicable to solicitors-general of the state courts. Employer contributions
shall be paid by the respective employers under such Code
sections."
SECTION
2.
In
the event of an irreconcilable conflict between a provision of this Act and a
provision of another Act enacted at the 2011 regular session of the General
Assembly, the provision of such other Act shall control over this Act to the
extent of the conflict.
SECTION
3.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
4.
All
laws and parts of laws in conflict with this Act are repealed.
