   17         cross-references; amending s. 320.08058, F.S.;
   18         deleting specified specialty license plates; revising
   19         provisions relating to specified specialty license
   20         plates; conforming cross-references; amending ss.
   21         320.08056 and 320.08058, F.S.; directing the
   22         Department of Highway Safety and Motor Vehicles to
   23         develop certain specialty license plates; establishing
   24         an annual use fee for the plates; providing for
   25         distribution and use of fees collected from the sale
   26         of the plates; providing effective dates.
   27          
   28  Be It Enacted by the Legislature of the State of Florida:
   29  
   30         Section 1. Section 320.08053, Florida Statutes, is amended
   31  to read:
   32         320.08053 Establishment of Requirements for requests to
   33  establish specialty license plates.—
   34         (1) An organization that seeks authorization to establish a
   35  new specialty license plate for which an annual use fee is to be
   36  charged must submit to the department:
   37         (a) A request for the particular specialty license plate
   38  being sought, describing the proposed specialty license plate in
   39  specific terms, including a sample plate that conforms to the
   40  specifications set by the department and this chapter, and that
   41  is in substantially final form.
   42         (b) An application fee, not to exceed $60,000, to defray
   43  the department’s cost for reviewing the application and
   44  developing the specialty license plate, if authorized. State
   45  funds may not be used to pay the application fee, except for
   46  collegiate specialty license plates authorized in s.
   47  320.08058(3) and (13). All applications requested on or after
   48  the effective date of this act must meet the requirements of
   49  this act.
   50         (c) A marketing strategy outlining short-term and long-term
   51  marketing plans for the requested specialty license plate and a
   52  financial analysis outlining the anticipated revenues and the
   53  planned expenditures of the revenues to be derived from the sale
   54  of the requested specialty license plates.
   55  
   56  The information required under this subsection must be submitted
   57  to the department at least 90 days before the convening of the
   58  next regular session of the Legislature.
   59         (1)(2) If a the specialty license plate requested by an the
   60  organization is approved by law, the organization must submit
   61  the proposed art design for the specialty license plate to the
   62  department, in a medium prescribed by the department, as soon as
   63  practicable, but no later than 60 days after the act approving
   64  the specialty license plate becomes a law. If the specialty
   65  license plate requested by the organization is not approved by
   66  the Legislature or does not meet the presale requirements in
   67  subsection (3), the application fee shall be refunded to the
   68  requesting organization.
   69         (2)(3)(a) Within 120 days following the specialty license
   70  plate becoming law, the department shall establish a method to
   71  issue a specialty license plate voucher to allow for the presale
   72  of the specialty license plate. The processing fee as prescribed
   73  in s. 320.08056, the service charge and branch fee as prescribed
   74  in s. 320.04, and the annual use fee as prescribed in s.
   75  320.08056 shall be charged for the voucher. All other applicable
   76  fees shall be charged at the time of issuance of the license
   77  plates.
   78         (b) Within 24 months after the presale specialty license
   79  plate voucher is established, the approved specialty license
   80  plate organization must record with the department a minimum of
   81  4,000 1,000 voucher sales before manufacture of the license
   82  plate may commence. If, at the conclusion of the 24-month
   83  presale period, the minimum sales requirements have not been
   84  met, the specialty plate is deauthorized and the department
   85  shall discontinue development of the plate and discontinue
   86  issuance of the presale vouchers. Upon deauthorization of the
   87  license plate, a purchaser of the license plate voucher may use
   88  the annual use fee collected as a credit towards any other
   89  specialty license plate or apply for a refund on a form
   90  prescribed by the department. This paragraph does not apply to
   91  specialty license plates that have statutory eligibility
   92  limitations for purchase.
   93         (c) An organization that meets the requirements of this
   94  subsection shall be deemed to have submitted a valid survey for
   95  purposes of s. 45, chapter 2008-176, Laws of Florida, as
   96  amended.
   97         Section 2. Subsection (3), paragraphs (iii), (ttt), and
   98  (uuu) of subsection (4), subsection (8), and paragraph (a) of
   99  subsection (10) of section 320.08056, Florida Statutes, are
  100  amended to read:
  101         320.08056 Specialty license plates.—
  102         (3) Each request must be made annually to the department or
  103  an authorized agent serving on behalf of the department,
  104  accompanied by the following tax and fees:
  105         (a) The license tax required for the vehicle as set forth
  106  in s. 320.08.
  107         (b) A processing fee of $5, to be deposited into the
  108  Highway Safety Operating Trust Fund.
  109         (c) A license plate fee as required by s. 320.06(1)(b).
  110         (d) A license plate annual use fee as required in
  111  subsection (4).
  112  
  113  A request may be made any time during a registration period. If
  114  a request is made for a specialty license plate to replace a
  115  current valid license plate, the specialty license plate must be
  116  issued with appropriate decals attached at no tax for the plate,
  117  but all fees and service charges must be paid. If a request is
  118  made for a specialty license plate at the beginning of the
  119  registration period, the tax, together with all applicable fees
  120  and service charges, must be paid.
  121         (4) The following license plate annual use fees shall be
  122  collected for the appropriate specialty license plates:
  123         (iii) Corrections Foundation license plate, $25.
  124         (ttt) Children First license plate, $25.
  125         (uuu) Veterans of Foreign Wars license plate, $25.
  126         (8)(a) The department must discontinue the issuance of an
  127  approved specialty license plate if the number of valid
  128  specialty plate registrations falls below 1,000 plates for at
  129  least 12 consecutive months. A warning letter shall be mailed to
  130  the sponsoring organization following the first month in which
  131  the total number of valid specialty plate registrations is below
  132  1,000 plates. Beginning July 1, 2020, the department shall
  133  discontinue the issuance of an approved specialty license plate
  134  if the number of valid specialty plate registrations falls below
  135  4,000 for at least 12 consecutive months. A warning letter shall
  136  be mailed to the sponsoring organization following the first
  137  month in which the total number of valid specialty plate
  138  registrations is below 4,000 plates. This paragraph does not
  139  apply to collegiate license plates established under s.
  140  320.08058(3) or specialty license plates that have statutory
  141  eligibility limitations for purchase.
  142         (b) The department is authorized to discontinue the
  143  issuance of a specialty license plate and distribution of
  144  associated annual use fee proceeds if the organization no longer
  145  exists, if the organization has stopped providing services that
  146  are authorized to be funded from the annual use fee proceeds, if
  147  the organization does not meet the presale requirements as
  148  prescribed in s. 320.08053(2) s. 320.08053(3), or pursuant to an
  149  organizational recipient’s request. Organizations shall notify
  150  the department immediately to stop all warrants for plate sales
  151  if any of the conditions in this section exist and must meet the
  152  requirements of s. 320.08062 for any period of operation during
  153  a fiscal year.
  154         (10)(a) A specialty license plate annual use fee collected
  155  and distributed under this chapter, or any interest earned from
  156  those fees, may not be used for commercial or for-profit
  157  activities nor for general or administrative expenses, except as
  158  authorized by s. 320.08058 or to pay the cost of the audit or
  159  report required by s. 320.08062(1). The fees and any interest
  160  earned from the fees may be expended only for use in this state
  161  unless the annual use fee is derived from the sale of United
  162  States Armed Forces and veterans-related specialty license
  163  plates pursuant to paragraphs (4)(d), (bb), (ll), (kkk), and
  164  (yyy) (lll), (uuu), and (bbbb) and s. 320.0891.
  165         Section 3. Paragraph (b) of subsection (48), subsection
  166  (61), paragraph (b) of present subsection (67), paragraph (b) of
  167  present subsection (70), paragraph (d) of present subsection
  168  (71), present subsections (72) and (73), paragraph (a) of
  169  present subsection (79), paragraph (a) of present subsection
  170  (80), paragraph (a) of present subsection (81), paragraph (a) of
  171  present subsection (82), paragraph (a) of present subsection
  172  (83), paragraph (a) of present subsection (84), paragraph (a) of
  173  present subsection (85), and paragraph (a) of present subsection
  174  (86) of section 320.08058, Florida Statutes, are amended to
  175  read:
  176         320.08058 Specialty license plates.—
  177         (48) LIVE THE DREAM LICENSE PLATES.—
  178         (b) The proceeds of the annual use fee shall be distributed
  179  to the Living the Dream Foundation, Inc. The Living the Dream
  180  Foundation, Inc., shall retain the first $60,000 in proceeds
  181  from the annual use fees as reimbursement for administrative
  182  costs, startup costs, and costs incurred in the approval
  183  process. Thereafter, up to 25 percent shall be used for
  184  continuing promotion and marketing of the license plate and
  185  concept. The remaining funds shall be used in the following
  186  manner:
  187         1. Twenty-five percent shall be distributed to the Sickle
  188  Cell Disease Association of Florida, Inc., to be distributed
  189  equally among the sickle cell organizations that are Florida
  190  members of the Sickle Cell Disease Association of America, Inc.,
  191  for programs that provide research, care, and treatment for
  192  sickle cell disease.
  193         2. Twenty-five percent shall be distributed to the Miami
  194  Children’s Initiative, Inc., Florida chapter of the March of
  195  Dimes for programs and services that improve the health of
  196  babies through the prevention of birth defects and infant
  197  mortality to provide a unified system of support, education, and
  198  care that begins before birth and continues through college and
  199  career.
  200         3. Ten percent shall be distributed to the Florida
  201  Association of Healthy Start Coalitions, Inc., to decrease
  202  racial disparity in infant mortality and to increase healthy
  203  birth outcomes. Funding will be used by local Healthy Start
  204  Coalitions to provide services and increase screening rates for
  205  high-risk pregnant women, children under 4 years of age, and
  206  women of childbearing age.
  207         4. Ten percent shall be distributed to the Chapman
  208  Partnership, Inc., Community Partnership for Homeless, Inc., for
  209  programs that provide relief from poverty, hunger, and
  210  homelessness.
  211         5. Five percent of the proceeds shall be used by the
  212  foundation for administrative costs directly associated with
  213  operations as they relate to the management and distribution of
  214  the proceeds.
  215         (61) CORRECTIONS FOUNDATION LICENSE PLATES.—
  216         (a) The department shall develop a Corrections Foundation
  217  license plate as provided in this section. The word “Florida”
  218  must appear at the top of the plate, the words “Corrections
  219  Foundation” must appear at the bottom of the plate, and the
  220  Corrections Foundation logo must appear to the left of the
  221  numerals.
  222         (b) The annual use fees shall be distributed to Corrections
  223  Foundation, Inc., a direct-support organization created pursuant
  224  to s. 944.802, and shall be used to continue and expand the
  225  charitable work of the foundation, as provided in s. 944.802 and
  226  the articles of incorporation of the foundation.
  227         (66)(67) IN GOD WE TRUST LICENSE PLATES.—
  228         (b) The annual use fees from the plate shall be distributed
  229  to the In God We Trust Foundation, Inc., which may use a maximum
  230  of 10 percent to offset marketing, administration, and promotion
  231  expenses and which may use the balance of the fees to address
  232  the needs of military servicemembers and their spouses and
  233  dependents, provide education in public and private schools
  234  regarding the historical significance of religion in American
  235  and Florida history, provide educational grants in public and
  236  private schools, address the needs of public safety employees
  237  and their spouses and dependents, and foster self-reliance and
  238  stability in Florida’s children and families.
  239         (b)The license plate annual use fees shall be distributed
  240  to the In God We Trust Foundation, Inc., to fund educational
  241  scholarships for the children of Florida residents who are
  242  members of the United States Armed Forces, the National Guard,
  243  and the United States Armed Forces Reserve and for the children
  244  of public safety employees who have died in the line of duty who
  245  are not covered by existing state law. Funds shall also be
  246  distributed to other s. 501(c)(3) organizations that may apply
  247  for grants and scholarships and to provide educational grants to
  248  public and private schools to promote the historical and
  249  religious significance of American and Florida history. The In
  250  God We Trust Foundation, Inc., shall distribute the license
  251  plate annual use fees in the following manner:
  252         1.The In God We Trust Foundation, Inc., shall retain all
  253  revenues from the sale of such plates until all startup costs
  254  for developing and establishing the plate have been recovered.
  255         2.Ten percent of the funds received by the In God We Trust
  256  Foundation, Inc., shall be expended for administrative costs,
  257  promotion, and marketing of the license plate directly
  258  associated with the operations of the In God We Trust
  259  Foundation, Inc.
  260         3.All remaining funds shall be expended by the In God We
  261  Trust Foundation, Inc., for programs.
  262         (69)(70) ST. JOHNS RIVER LICENSE PLATES.—
  263         (b) The requirements of s. 320.08053 must be met prior to
  264  the issuance of the plate. Thereafter, the license plate annual
  265  use fees shall be distributed to the St. Johns River Alliance,
  266  Inc., a s. 501(c)(3) nonprofit organization, which shall
  267  administer the fees as follows:
  268         1. The St. Johns River Alliance, Inc., shall retain the
  269  first $60,000 of the annual use fees as direct reimbursement for
  270  administrative costs, startup costs, and costs incurred in the
  271  development and approval process. Thereafter, up to 10 percent
  272  of the annual use fee revenue may be used for administrative
  273  costs directly associated with education programs, conservation,
  274  research, and grant administration of the organization, and up
  275  to 10 percent may be used for promotion and marketing of the
  276  specialty license plate.
  277         2. At least 30 percent of the fees shall be available for
  278  competitive grants for targeted community-based or county-based
  279  research or projects for which state funding is limited or not
  280  currently available. The remaining 50 percent shall be directed
  281  toward community outreach and access programs. The competitive
  282  grants shall be administered and approved by the board of
  283  directors of the St. Johns River Alliance, Inc. A grant advisory
  284  committee shall be composed of six members chosen by the St.
  285  Johns River Alliance board members.
  286         3. Any remaining funds shall be distributed with the
  287  approval of and accountability to the board of directors of the
  288  St. Johns River Alliance, Inc., and shall be used to support
  289  activities contributing to education, outreach, and springs
  290  conservation.
  291         4. Effective July 1, 2014, the St. Johns River license
  292  plate will shift into the presale voucher phase, as provided in
  293  s. 320.08053(2)(b) s. 320.08053(3)(b). The St. Johns River
  294  Alliance, Inc., shall have 24 months to record a minimum of
  295  1,000 sales of the license plates. Sales include existing active
  296  plates and vouchers sold subsequent to July 1, 2014. During the
  297  voucher period, new plates may not be issued, but existing
  298  plates may be renewed. If, at the conclusion of the 24-month
  299  presale period, the requirement of a minimum of 1,000 sales has
  300  been met, the department shall resume normal distribution of the
  301  St. Johns River specialty plate. If, after 24 months, the
  302  minimum of 1,000 sales has not been met, the department shall
  303  discontinue the development and issuance of the plate. This
  304  subparagraph is repealed June 30, 2016.
  305         (70)(71) HISPANIC ACHIEVERS LICENSE PLATES.—
  306         (d) Effective July 1, 2014, the Hispanic Achievers license
  307  plate will shift into the presale voucher phase, as provided in
  308  s. 320.08053(2)(b) s. 320.08053(3)(b). National Hispanic
  309  Corporate Achievers, Inc., shall have 24 months to record a
  310  minimum of 1,000 sales. Sales include existing active plates and
  311  vouchers sold subsequent to July 1, 2014. During the voucher
  312  period, new plates may not be issued, but existing plates may be
  313  renewed. If, at the conclusion of the 24-month presale period,
  314  the requirement of a minimum of 1,000 sales has been met, the
  315  department shall resume normal distribution of the Hispanic
  316  Achievers license plate. If, after 24 months, the minimum of
  317  1,000 sales has not been met, the department shall discontinue
  318  the Hispanic Achievers license plate. This subsection is
  319  repealed June 30, 2016.
  320         (72) CHILDREN FIRST LICENSE PLATES.—
  321         (a) Upon Children First Florida, Inc., meeting the
  322  requirements of s. 320.08053, the department shall develop a
  323  Children First license plate as provided in this section. The
  324  plate must bear the colors and design approved by the
  325  department. The word “Florida” must appear at the top of the
  326  plate, and the words “Children First” must appear at the bottom
  327  of the plate.
  328         (b) The proceeds from the license plate annual use fee
  329  shall be distributed to Children First Florida, Inc., which
  330  shall retain all proceeds until the startup costs to develop and
  331  establish the plates have been recovered. Thereafter, the
  332  proceeds shall be used as follows:
  333         1. A maximum of 10 percent of the proceeds may be used to
  334  administer the license plate program, for direct administrative
  335  costs associated with the operations of Children First Florida,
  336  Inc., and to promote and market the license plates.
  337         2. The remaining fees shall be used by Children First
  338  Florida, Inc., to fund public schools in this state, including
  339  teacher salaries.
  340         (73) VETERANS OF FOREIGN WARS LICENSE PLATES.—
  341         (a) Upon Veterans of Foreign Wars, Department of Florida,
  342  meeting the requirements of s. 320.08053, the department shall
  343  develop a Veterans of Foreign Wars license plate as provided in
  344  this section. The plates must bear the colors and design
  345  approved by the department and must incorporate the Great Seal
  346  of the Veterans of Foreign Wars of the United States as
  347  described in Art. VIII, s. 801 of the Congressional Charter and
  348  By-Laws of the Veterans of Foreign Wars of the United States.
  349  The word “Florida” must appear at the top of the plate, and the
  350  words “Veterans of Foreign Wars” must appear at the bottom of
  351  the plate.
  352         (b) The Veterans of Foreign Wars, Department of Florida
  353  shall retain all revenues from the sale of such plates until all
  354  startup costs for developing and issuing the plates have been
  355  recovered. Thereafter, 60 percent of the annual revenues shall
  356  be distributed to the Veterans of Foreign Wars, Department of
  357  Florida to support the Voice of Democracy and Patriots’ Pen
  358  Scholarship programs, to support high school and college ROTC
  359  programs, and for administration and marketing the plate; 20
  360  percent of the annual revenues shall be distributed to the
  361  direct-support organization created under s. 292.055 under the
  362  Florida Department of Veterans’ Affairs; and 20 percent of the
  363  annual revenues shall be distributed to the direct-support
  364  organization created under s. 250.115 under the Department of
  365  Military Affairs. From the funds distributed to the Veterans of
  366  Foreign Wars, Department of Florida, an amount not to exceed 10
  367  percent of the annual revenues received from the sale of the
  368  plate may be used for administration and marketing the plate.
  369         (76)(79) FREEMASONRY LICENSE PLATES.—
  370         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  371  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  372  and s. 320.08053(1), the department shall develop a Freemasonry
  373  license plate as provided in this section and s. 320.08053 s.
  374  320.08053(2) and (3). The word “Florida” must appear at the top
  375  of the plate, and the words “In God We Trust” must appear at the
  376  bottom of the plate.
  377         (77)(80) AMERICAN LEGION LICENSE PLATES.—
  378         (a) Notwithstanding s. 320.08053(1) and s. 45, chapter
  379  2008-176, Laws of Florida, as amended by s. 21, chapter 2010
  380  223, Laws of Florida, the department shall develop an American
  381  Legion license plate as provided in s. 320.08053 s. 320.08053(2)
  382  and (3) and this section. The plate must bear the colors and
  383  design approved by the department. The word “Florida” must
  384  appear at the top of the plate, and the words “American Legion”
  385  must appear at the bottom of the plate.
  386         (78)(81) LAUREN’S KIDS LICENSE PLATES.—
  387         (a) Notwithstanding s. 320.08053(1) and s. 45, chapter
  388  2008-176, Laws of Florida, as amended by s. 21, chapter 2010
  389  223, Laws of Florida, the department shall develop a Lauren’s
  390  Kids, Prevent Child Sexual Abuse license plate as provided in s.
  391  320.08053 s. 320.08053(2) and (3), and this section. The plate
  392  must bear the colors and design approved by the department. The
  393  word “Florida” must appear at the top of the plate, and the
  394  words “Lauren’s Kids” must appear at the bottom of the plate.
  395         (79)(82) BIG BROTHERS BIG SISTERS LICENSE PLATES.—
  396         (a) Notwithstanding s. 320.08053(1) and s. 45, chapter
  397  2008-176, Laws of Florida, as amended by s. 21, chapter 2010
  398  223, Laws of Florida, the department shall develop a Big
  399  Brothers Big Sisters license plate as provided in s. 320.08053
  400  s. 320.08053(2) and (3), and this section. The plate must bear
  401  the colors and design approved by the department. The word
  402  “Florida” must appear at the top of the plate, and the words
  403  “Big Brothers Big Sisters” must appear at the bottom of the
  404  plate.
  405         (80)(83) FALLEN LAW ENFORCEMENT OFFICERS LICENSE PLATES.—
  406         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  407  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  408  and s. 320.08053(1), the department shall develop a Fallen Law
  409  Enforcement Officers license plate as provided in s. 320.08053
  410  s. 320.08053(2) and (3) and this section. The plate must bear
  411  the colors and design approved by the department. The word
  412  “Florida” must appear at the top of the plate, and the words “A
  413  Hero Remembered Never Dies” must appear at the bottom of the
  414  plate.
  415         (81)(84) FLORIDA SHERIFFS ASSOCIATION LICENSE PLATES.—
  416         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  417  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  418  and s. 320.08053(1), the department shall develop a Florida
  419  Sheriffs Association license plate as provided in s. 320.08053
  420  s. 320.08053(2) and (3) and this section. The plate must bear
  421  the colors and design approved by the department. A sheriff’s
  422  star must appear on the left side of the plate, the word
  423  “Florida” must appear at the top of the plate, and the words
  424  “Florida Sheriffs Association” must appear at the bottom of the
  425  plate.
  426         (82)(85) KEISER UNIVERSITY LICENSE PLATES.—
  427         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  428  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  429  and s. 320.08053(1), the department shall develop a Keiser
  430  University license plate as provided in s. 320.08053 s.
  431  320.08053(2) and (3) and this section. The plate must bear the
  432  colors and design approved by the department. The word “Florida”
  433  must appear at the top of the plate, and the words “Keiser
  434  University” must appear at the bottom of the plate.
  435         (83)(86) MOFFITT CANCER CENTER LICENSE PLATES.—
  436         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  437  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  438  and s. 320.08053(1), the department shall develop a Moffitt
  439  Cancer Center license plate as provided in s. 320.08053 s.
  440  320.08053(2) and (3) and this section. The word “Florida” must
  441  appear at the top of the plate, and the words “Moffitt Cancer
  442  Center” must appear at the bottom of the plate.
  443         Section 4. Effective October 1, 2015, paragraphs (ffff)
  444  through (hhhhh) are added to subsection (4) of section
  445  320.08056, Florida Statutes, to read:
  446         320.08056 Specialty license plates.—
  447         (4) The following license plate annual use fees shall be
  448  collected for the appropriate specialty license plates:
  449         (ffff) Bonefish and Tarpon Trust license plate, $25.
  450         (gggg) Rotary’s Camp Florida license plate, $25.

  475         (eeeee) Play Ball license plate, $25.
  476         (fffff) Medical Professionals Who Care license plate, $25.
  477         (ggggg) Go Green license plate, $25.
  478         (hhhhh) National Wild Turkey Federation license plate, $25.
  479         Section 5. Effective October 1, 2015, subsection (9) of
  480  section 320.08058, Florida Statutes, is amended, and subsections
  481  (84) through (105) are added to that section, to read:
  482         320.08058 Specialty license plates.—
  483         (9) FLORIDA PROFESSIONAL SPORTS TEAM LICENSE PLATES.—
  484         (a) The Department of Highway Safety and Motor Vehicles
  485  shall develop a Florida Professional Sports Team license plate
  486  as provided in this section for Major League Baseball, National
  487  Basketball Association, National Football League, Arena Football
  488  League Teams, and National Hockey League, Major League Soccer,
  489  and North American Soccer League teams domiciled in this state.
  490  However, any Florida Professional Sports Team license plate
  491  created or established after January 1, 1997, must comply with
  492  the requirements of s. 320.08053 and be specifically authorized
  493  by an act of the Legislature. Florida Professional Sports Team
  494  license plates must bear the colors and design approved by the
  495  department and must include the official league or team logo, or
  496  both, as appropriate for each team. The word “Florida” must
  497  appear at the top of the plate.
  498         (b) The license plate annual use fees are to be annually
  499  distributed as follows:
  500         1. Fifty-five percent of the proceeds from the Florida
  501  Professional Sports Team plate must be deposited into the
  502  Professional Sports Development Trust Fund within the Department
  503  of Economic Opportunity. These funds must be used solely to
  504  attract and support major sports events in this state. As used
  505  in this subparagraph, the term “major sports events” means, but
  506  is not limited to, championship or all-star contests of Major
  507  League Baseball, the National Basketball Association, the
  508  National Football League, the National Hockey League, Major
  509  League Soccer, the North American Soccer League, the men’s and
  510  women’s National Collegiate Athletic Association Final Four
  511  basketball championship, or a horseracing or dogracing Breeders’
  512  Cup. All funds must be used to support and promote major
  513  sporting events, and the uses must be approved by the Department
  514  of Economic Opportunity.
  515         2. The remaining proceeds of the Florida Professional
  516  Sports Team license plate must be allocated to Enterprise
  517  Florida, Inc. These funds must be deposited into the
  518  Professional Sports Development Trust Fund within the Department
  519  of Economic Opportunity. These funds must be used by Enterprise
  520  Florida, Inc., to promote the economic development of the sports
  521  industry; to distribute licensing and royalty fees to
  522  participating professional sports teams; to promote education
  523  programs in Florida schools that provide an awareness of the
  524  benefits of physical activity and nutrition standards; to
  525  partner with the Department of Education and the Department of
  526  Health to develop a program that recognizes schools whose
  527  students demonstrate excellent physical fitness or fitness
  528  improvement; to institute a grant program for communities
  529  bidding on minor sporting events that create an economic impact
  530  for the state; to distribute funds to Florida-based charities
  531  designated by Enterprise Florida, Inc., and the participating
  532  professional sports teams; and to fulfill the sports promotion
  533  responsibilities of the Department of Economic Opportunity.
  534         3. Enterprise Florida, Inc., shall provide an annual
  535  financial audit in accordance with s. 215.981 of its financial
  536  accounts and records by an independent certified public
  537  accountant pursuant to the contract established by the
  538  Department of Economic Opportunity. The auditor shall submit the
  539  audit report to the Department of Economic Opportunity for
  540  review and approval. If the audit report is approved, the
  541  Department of Economic Opportunity shall certify the audit
  542  report to the Auditor General for review.
  543         4. Notwithstanding the provisions of subparagraphs 1. and
  544  2., proceeds from the Professional Sports Development Trust Fund
  545  may also be used for operational expenses of Enterprise Florida,
  546  Inc., and financial support of the Sunshine State Games.
  547         (84) BONEFISH AND TARPON TRUST LICENSE PLATES.—
  548         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  549  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  550  and s. 45, chapter 2014-216, Laws of Florida, the department
  551  shall develop a Bonefish and Tarpon Trust license plate as
  552  provided in this section and s. 320.08053. Bonefish and Tarpon
  553  Trust license plates must bear the colors and design approved by
  554  the department. The word “Florida” must appear at the top of the
  555  plate, and the words “Bonefish and Tarpon Trust” must appear at
  556  the bottom of the plate.
  557         (b) The department shall retain all annual use fees from
  558  the sale of such plates until all startup costs for developing
  559  and issuing the plates have been recovered. Thereafter, the
  560  balance of the fees shall be distributed to the Bonefish and
  561  Tarpon Trust, which:
  562         1. May use a maximum of 10 percent of the proceeds to
  563  promote and market the Bonefish and Tarpon Trust license plate.
  564         2. Shall invest and reinvest the remainder of the proceeds
  565  and use the interest earnings to conserve and enhance Florida
  566  bonefish and tarpon fisheries and their respective environments
  567  through stewardship, research, education, and advocacy.
  568         (85) ROTARY’S CAMP FLORIDA LICENSE PLATES.—
  569         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  570  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  571  and s. 45, chapter 2014-216, Laws of Florida, the department
  572  shall develop a Rotary’s Camp Florida license plate as provided
  573  in this section and s. 320.08053. Rotary’s Camp Florida license
  574  plates must bear the colors and design approved by the
  575  department. The word “Florida” must appear at the top of the
  576  plate, and the words “Rotary’s Camp Florida” must appear at the
  577  bottom of the plate.
  578         (b) The license plate annual use fees shall be distributed
  579  to Rotary’s Camp Florida, which may use a maximum of 10 percent
  580  of the proceeds for administrative costs and for marketing the
  581  plate. Thereafter, up to 23 percent shall be distributed as
  582  grants for Florida Rotary Districts that provide camp services
  583  to children in this state, and the balance of the proceeds shall
  584  be used by Rotary’s Camp Florida for direct support to the
  585  programs and services provided to children who attend the camp.
  586         (86) SUPPORT DOWN SYNDROME LICENSE PLATES.—
  587         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  588  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  589  and s. 45, chapter 2014-216, Laws of Florida, the department
  590  shall develop a Support Down Syndrome license plate as provided
  591  in this section and s. 320.08053. Support Down Syndrome license
  592  plates must bear the colors and design approved by the
  593  department. The word “Florida” must appear at the top of the
  594  plate, and the words “Support Down Syndrome” must appear at the
  595  bottom of the plate.
  596         (b) The license plate annual use fees shall be distributed
  597  to Olivia’s Angels Foundation, Inc., to fund its activities,
  598  programs, and projects within this state. Olivia’s Angels
  599  Foundation, Inc., may retain all revenues from the annual use
  600  fees until all startup costs for developing and establishing the
  601  plate have been recovered. Thereafter, up to 10 percent of the
  602  annual use fee revenues may be used for administrative costs and
  603  promotion and marketing of the specialty license plate.
  604         (87) SAFE AND FREE FLORIDA LICENSE PLATES.-
  605         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  606  Florida, as amended by s. 21, chapter 2010-223 and s. 45,
  607  chapter 2014-216, Laws of Florida, the department shall develop
  608  a Safe and Free Florida license plate as provided in this
  609  section and s. 320.08053. The word “Florida” must appear at the
  610  top of the plate, and the words “End Human Trafficking” must
  611  appear at the bottom of the plate.
  612         (b) The department shall retain all annual use fees from
  613  the sale of such plates until all startup costs for developing
  614  and issuing the plates have been recovered. Thereafter, the
  615  annual use fees from the sale of the plate shall be distributed
  616  to the Department of Legal Affairs, which:
  617         1. May use up to 15 percent of the proceeds to promote and
  618  market the license plate.
  619         2. Shall establish a program to award grants to
  620  nongovernmental organizations that shall use the awarded funds:
  621         a. To provide for the material needs of sexually abused,
  622  exploited, or trafficked victims, including, but not limited to,
  623  clothing, housing, medical care, food, utilities, and
  624  transportation.
  625         b. For detoxification services.
  626         c. For prenatal and postnatal care and to provide services
  627  for infants awaiting placement with adoptive parents.
  628         d. To purchase or lease real estate to facilitate a safe
  629  house or a transitional care or recovery care center.
  630         e. For counseling, training, awareness, and prevention
  631  programs for sexually abused, exploited, or trafficked victims.
  632         f. To provide emergency legal advocacy to sexually abused
  633  or trafficked victims at a rate established by the Department of
  634  Legal Affairs.
  635         (c) The Department of Legal Affairs may not distribute
  636  funds under paragraph (b) to any nongovernmental organization
  637  that charges victims for services received through this funding.
  638  An organization that receives the funds may not use the funds
  639  for administrative or capital expenditures. Each organization
  640  that receives funds must submit an annual attestation to the
  641  Department of Legal Affairs no later than December 31. The
  642  Department of Legal Affairs shall adopt and enforce rules to
  643  implement this subsection.
  644         (88) SUN SEA SMILES LICENSE PLATES.—
  645         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  646  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  647  and s. 45, chapter 2014-216, Laws of Florida, the department
  648  shall develop a Sun Sea Smiles license plate as provided in this
  649  section and s. 320.08053. Sun Sea Smiles license plates must
  650  bear the colors and design approved by the department. The word
  651  “Florida” must appear at the top of the plate, and the words
  652  “Sun Sea Smiles” must appear at the bottom of the plate.
  653         (b) The department shall retain all annual use fees from
  654  the sale of such plates until all startup costs for developing
  655  and issuing the plates have been recovered. Thereafter, the
  656  license plate annual use fees shall be distributed as follows:
  657         1. Five percent shall be distributed to the Florida
  658  Caribbean Charitable Foundation, Inc., for marketing the Sun Sea
  659  Smiles license plate.
  660         2. Thirty percent shall be distributed to the Florida
  661  Caribbean Charitable Foundation, Inc. Of this amount, up to 5
  662  percent may be used for administrative expenses, and the
  663  remainder shall be used as follows:
  664         a. Sixty percent shall be used for a college scholarship
  665  program.
  666         b. Fifteen percent shall be used to promote health and
  667  wellness among Florida residents of Caribbean descent.
  668         c. Twenty-five percent shall be used to promote awareness
  669  of Caribbean culture within the state.
  670         3. Twenty percent shall be distributed to the American
  671  Friends of Jamaica, Inc., a charitable, not-for-profit
  672  organization under s. 501(c)(3) of the Internal Revenue Code
  673  registered with the Department of Agriculture and Consumer
  674  Services and incorporated in New York, for use as grants to
  675  promote social and community development among residents of this
  676  state. Of this amount, up to 5 percent may be used for
  677  administrative and marketing expenses.
  678         4. Ten percent shall be distributed to Haitian Neighborhood
  679  Center Sant La, Inc., to promote social and community
  680  development. Of this amount, up to 5 percent may be used for
  681  administrative expenses.
  682         5. Ten percent shall be distributed to Fanm Ayisyen nan
  683  Miyami, Inc., to promote social and community development. Of
  684  this amount, up to 10 percent may be used for administrative
  685  expenses.
  686         6. Twenty percent shall be distributed to Greater Caribbean
  687  American Cultural Coalition, Inc., to promote awareness of
  688  Caribbean culture within this state. Of this amount, up to 5
  689  percent may be used for administrative expenses.
  690         7. Five percent shall be distributed to Little Haiti
  691  Optimist Foundation, Inc., to promote awareness of Caribbean
  692  culture and youth development within this state. Of this amount,
  693  up to 5 percent may be used for administrative expenses.
  694         (89) TAKE STOCK IN CHILDREN LICENSE PLATES.—
  695         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  696  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  697  and s. 45, chapter 2014-216, Laws of Florida, the department
  698  shall develop a Take Stock in Children license plate as provided
  699  in this section and s. 320.08053. Take Stock in Children license
  700  plates must bear the colors and design approved by the
  701  department. The word “Florida” must appear at the top of the
  702  plate, and the words “Take Stock in Children” must appear at the
  703  bottom of the plate.
  704         (b) The license plate annual use fees shall be distributed
  705  to Take Stock in Children, Inc., to fund its activities,
  706  scholarship and mentoring programs, and projects. Take Stock in
  707  Children, Inc., may retain all revenues from the annual use fees
  708  until all startup costs for developing and establishing the
  709  plate have been recovered. Thereafter, up to 10 percent of the
  710  annual use fee revenue may be used for administrative costs
  711  directly associated with the corporation’s programs and the
  712  specialty license plate, and up to 15 percent may be used for
  713  promotion and marketing of the specialty license plate.
  714         (90) PADDLE FLORIDA LICENSE PLATES.—
  715         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  716  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  717  and s. 45, chapter 2014-216, Laws of Florida, the department
  718  shall develop a Paddle Florida license plate as provided in this
  719  section and s. 320.08053. Paddle Florida license plates must
  720  bear the colors and design approved by the department. The word
  721  “Florida” must appear at the top of the plate, and words
  722  approved by the department must appear at the bottom of the
  723  plate.
  724         (b) The department shall retain all license plate annual
  725  use fees until the startup costs for developing and issuing the
  726  plates have been recovered. Thereafter, the annual use fees
  727  shall be distributed to Paddle Florida, Inc., which may use up
  728  to 10 percent of the proceeds for administrative costs and
  729  marketing of the plate. The balance of the fees shall be used by
  730  the Florida Forever grant program to support activities that
  731  further outdoor recreation and natural resource protection.
  732         (91) ORLANDO CITY SOCCER CLUB LICENSE PLATES.
  733  Notwithstanding s. 45, chapter 2008-176, Laws of Florida, as
  734  amended by s. 21, chapter 2010-223, Laws of Florida, and s. 45,
  735  chapter 2014-216, Laws of Florida, the department shall develop
  736  an Orlando City Soccer Club license plate as provided in
  737  subsection (9).
  738         (92) DOGS MAKING A DIFFERENCE LICENSE PLATES.—
  739         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  740  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  741  and s. 45, chapter 2014-216, Laws of Florida, the department
  742  shall develop a Dogs Making a Difference license plate as
  743  provided in this section and s. 320.08053. Dogs Making a
  744  Difference license plates must bear the colors and design
  745  approved by the department. The word “Florida” must appear at
  746  the top of the plate, and the words “Dogs Making a Difference”
  747  must appear at the bottom of the plate.
  748         (b) The department may retain all license plate annual use
  749  fees until the startup costs for developing and issuing the
  750  plates have been recovered. Thereafter, the annual use fees
  751  shall be distributed to Southeastern Guide Dogs, Inc., which may
  752  use up to 10 percent of the proceeds for administrative costs
  753  and marketing of the plate. The balance of the fees shall be
  754  used by Southeastern Guide Dogs, Inc., for the training and
  755  promotion of dogs for use by veterans and citizens who are
  756  blind.
  757         (93) DUCKS UNLIMITED LICENSE PLATES.—
  758         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  759  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  760  and s. 45, chapter 2014-216, Laws of Florida, the department
  761  shall develop a Ducks Unlimited license plate as provided in
  762  this section and s. 320.08053. Ducks Unlimited license plates
  763  must bear the colors and design approved by the department. The
  764  word “Florida” must appear at the top of the plate, and the
  765  words “Conserving Florida’s Wetlands” must appear at the bottom
  766  of the plate.
  767         (b) The license plate annual use fees shall be distributed
  768  to Ducks Unlimited, Inc., a not-for-profit corporation under s.
  769  501(c)(3) of the Internal Revenue Code. The proceeds must be
  770  used to support Ducks Unlimited’s mission and conservation
  771  efforts in this state as follows:
  772         1. Up to 5 percent may be used for administrative costs and
  773  marketing of the plate.
  774         2. A minimum of 95 percent shall be used to support Ducks
  775  Unlimited’s mission and efforts for the conservation,
  776  restoration, and management of Florida wetlands and associated
  777  habitats for the benefit of waterfowl, other wildlife, and
  778  people.
  779         (94) TEAM HAMMY LICENSE PLATES.—
  780         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  781  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  782  and s. 45, chapter 2014-216, Laws of Florida, the department
  783  shall develop a Team Hammy license plate as provided in this
  784  section and s. 320.08053. Team Hammy license plates must bear
  785  the colors and design approved by the department. The word
  786  “Florida” must appear at the top of the plate, and the words
  787  “Team Hammy” must appear at the bottom of the plate.
  788         (b) The department shall retain all license plate annual
  789  use fees until all startup costs for developing and issuing the
  790  plates have been recovered. Thereafter, the license plate annual
  791  use fees shall be distributed to Team Hammy, Inc., a Florida
  792  not-for-profit corporation, which may use up to 10 percent of
  793  such fees for administrative costs and marketing of the plate.
  794  The balance of the fees shall be used by Team Hammy, Inc., to
  795  grant wishes to families living with amyotrophic lateral
  796  sclerosis (ALS), to provide continuing education to caregivers
  797  and physicians, and to increase awareness of ALS in the
  798  community.
  799         (95) FLORIDA BAY FOREVER LICENSE PLATES.—
  800         (a) Notwithstanding s. 45 of chapter 2008-176, Laws of
  801  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  802  and s. 45, chapter 2014-216, Laws of Florida, the department
  803  shall develop a Florida Bay Forever license plate as provided in
  804  this section and s. 320.08053. Florida Bay Forever license
  805  plates must bear the colors and design approved by the
  806  department. The word “Florida” must appear at the top of the
  807  plate, and the words “Florida Bay Forever” must appear at the
  808  bottom of the plate.
  809         (b) The department shall retain all license plate annual
  810  use fees until all startup costs for developing and issuing the
  811  plates have been recovered. Thereafter, the annual use fees
  812  shall be distributed to the Florida National Park Association,
  813  Inc., which may use up to 10 percent of such fees for
  814  administrative costs and marketing of the plate. The balance of
  815  the fees shall be used to supplement the Everglades National
  816  Park budgets and to support educational, interpretive,
  817  historical, and scientific research relating to the Everglades
  818  National Park.
  819         (96) JACKSONVILLE ARMADA FOOTBALL CLUB LICENSE PLATES.
  820  Notwithstanding s. 45, chapter 2008-176, Laws of Florida, as
  821  amended by s. 21, chapter 2010-223, Laws of Florida, and s. 45,
  822  chapter 2014-216, Laws of Florida, the department shall develop
  823  a Jacksonville Armada Football Club license plate as provided in
  824  subsection (9).
  825         (97) TAMPA BAY ROWDIES LICENSE PLATES.—Notwithstanding s.
  826  45, chapter 2008-176, Laws of Florida, as amended by s. 21,
  827  chapter 2010-223, Laws of Florida, and s. 45, chapter 2014-216,
  828  Laws of Florida, the department shall develop a Tampa Bay
  829  Rowdies license plate as provided in subsection (9).
  830         (98) FURRY FRIENDS LICENSE PLATES.—
  831         (a) Notwithstanding s. 45 of chapter 2008-176, Laws of
  832  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  833  and s. 45, chapter 2014-216, Laws of Florida, the department
  834  shall develop a Furry Friends license plate as provided in this
  835  section and s. 320.08053, upon application by Furry Friends of
  836  Florida, Inc. Furry Friends license plates must bear the colors
  837  and design approved by the department. The word “Florida” must
  838  appear at the top of the plate, and words approved by the
  839  department must appear at the bottom of the plate.
  840         (b) The department shall retain all revenue from the sale
  841  of such plates until the startup costs for developing and
  842  issuing the plates have been recovered. Thereafter, the annual
  843  use fees shall be distributed monthly to Furry Friends of
  844  Florida, Inc., which may use up to 15 percent of such revenue
  845  for administrative, handling, and disbursement contracts and
  846  expenses, and up to 10 percent for promotion, advertising, and
  847  marketing contracts and costs. The balance of the fees shall be
  848  used by Furry Friends of Florida, Inc., for activities,
  849  programs, and projects, including, but not limited to, pet
  850  rescue, animal shelters, pet vaccination, veterinary services,
  851  and service animals.
  852         (99) SAVE OUR SHORES FLORIDA LICENSE PLATES.—
  853         (a)Notwithstanding s. 45, chapter 2008-176, Laws of
  854  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  855  and s. 45, chapter 2014-216, Laws of Florida, the department
  856  shall develop a Save Our Shores Florida license plate as
  857  provided in this section and s. 320.08053. Save Our Shores
  858  Florida license plates must bear the colors and design approved
  859  by the department. The word “Florida” must appear at the top of
  860  the plate, and the words “Save Our Shores” must appear at the
  861  bottom of the plate.
  862         (b) The department shall retain all annual use fees from
  863  the sale of such plates until startup costs for developing and
  864  issuing the plates have been recovered. Thereafter, the annual
  865  use fees shall be distributed to Adore the Shore, Inc., which
  866  may retain all of such revenue until the startup costs to
  867  develop and establish the license plate program have been
  868  recovered. Thereafter, Adore the Shore, Inc., may use the
  869  proceeds as follows:
  870         1.A maximum of 15 percent may be used for administrative
  871  costs of the organization.
  872         2. A maximum of 10 percent may be used for promotion and
  873  marketing costs of the license plate program.
  874         3.The remainder shall be used to fund activities,
  875  programs, and projects that provide for cleanup activities on
  876  Florida’s beaches following natural or manmade occurrences that
  877  threaten the pristine nature of Florida’s beaches and any other
  878  legal purpose as allowed by the Internal Revenue Code.
  879         (100) SUPPORT OUR CONSTITUTION LICENSE PLATES.—
  880         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
  881  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
  882  and s. 45, chapter 2014-216, Laws of Florida, the department
  883  shall develop a Support Our Constitution license plate as
  884  provided in this section and s. 320.08053. Support Our
  885  Constitution license plates must bear the colors and design
  886  approved by the department. The word “Florida” must appear at
  887  the top of the plate, and the words “Support Our Constitution”
  888  must appear at the bottom of the plate.
  889         (b) The annual use fees shall be distributed to The
  890  Constitution Foundation, Inc., which may retain all proceeds
  891  from the annual use fees until the startup costs for developing
  892  and issuing the license plates have been recovered. Thereafter,
  893  The Constitution Foundation, Inc., may use the proceeds as
  894  follows:
  895         1. A maximum of 15 percent may be used for administrative
  896  costs of the organization.
  897         2. A maximum of 10 percent may be used for promotion and
  898  marketing costs of the license plate.
  899         3. The remainder shall be used to fund the activities,
  900  programs, and projects of The Constitution Foundation, Inc.
  901         (101)PAN-HELLENIC LICENSE PLATES.—Notwithstanding s. 45,
  902  chapter 2008-176, Laws of Florida, as amended by s. 21, chapter
  903  2010-223 and s. 45, chapter 2014-216, Laws of Florida, the
  904  department shall develop a Pan-Hellenic Sorority or Fraternity
  905  license plate as provided in this section and s. 320.08053 for
  906  each of the following sororities and fraternities. Pan-Hellenic
  907  Sorority or Fraternity license plates must bear the colors and
  908  design approved by the department. The word “Florida” must
  909  appear at the top of the plate, and the name of the respective
  910  sorority or fraternity must appear at the bottom of the plate:
  911         (a)Alpha Phi Alpha Fraternity, Inc.—The department shall
  912  retain all annual use fees from the sale of such plates until
  913  all startup costs for developing and issuing plates have been
  914  recovered. Thereafter, the annual use fees from the sale of the
  915  plate shall be distributed as follows:
  916         1. Ten percent shall be distributed to the Florida
  917  Federation of Alpha Phi Alpha Fraternity Foundation, Inc., a
  918  charitable, not-for-profit organization under s. 501(c)(3) of
  919  the Internal Revenue Code registered with the Department of
  920  Agriculture and Consumer Services and incorporated in Florida,
  921  strictly for marketing the Alpha Phi Alpha Fraternity, Inc.,
  922  license plate.
  923         2.Eighty-five percent shall be distributed to the Florida
  924  Federation of Alpha Phi Alpha Fraternity Foundation, Inc., to
  925  promote community awareness and action through educational,
  926  economic, and cultural service activities.
  927         3.Five percent shall be distributed to the United Negro
  928  College Fund to be used for college scholarships for Florida
  929  residents attending historically black colleges and
  930  universities.
  931         (b)Omega Psi Phi Fraternity, Inc.—The department shall
  932  retain all annual use fees from the sale of such plates until
  933  all startup costs for developing and issuing plates have been
  934  recovered. Thereafter, the annual use fees from the sale of the
  935  plate shall be distributed as follows:
  936         1.Ten percent shall be distributed to Omega Friendship
  937  Foundation, Inc., a charitable, not-for-profit organization
  938  under s. 501(c)(3) of the Internal Revenue Code registered with
  939  the Department of Agriculture and Consumer Services and
  940  incorporated in Florida, strictly for marketing the Omega Psi
  941  Phi Fraternity, Inc., license plate.
  942         2.Eighty-five percent shall be distributed to Omega
  943  Friendship Foundation, Inc., to promote community awareness and
  944  action through educational, economic, and cultural service
  945  activities.
  946         3.Five percent shall be distributed to the United Negro
  947  College Fund to be used for college scholarships for Florida
  948  residents attending historically black colleges and
  949  universities.
  950         (c)Kappa Alpha Psi Fraternity, Inc.—The department shall
  951  retain all annual use fees from the sale of such plates until
  952  all startup costs for developing and issuing plates have been
  953  recovered. Thereafter, the annual use fees from the sale of the
  954  plate shall be distributed as follows:
  955         1.Ten percent shall be distributed to the Southern
  956  Province Kappa Alpha Psi Fraternity, Inc., a charitable, not
  957  for-profit organization under s. 501(c)(3) of the Internal
  958  Revenue Code registered with the Department of Agriculture and
  959  Consumer Services and incorporated in Florida, strictly for
  960  marketing the Kappa Alpha Psi Fraternity, Inc., license plate.
  961         2.Eighty-five percent shall be distributed to the Southern
  962  Province Kappa Alpha Psi Fraternity, Inc., to promote community
  963  awareness and action through educational, economic, and cultural
  964  service activities.
  965         3.Five percent shall be distributed to the United Negro
  966  College Fund to be used for college scholarships for the Florida
  967  residents attending historically black colleges and
  968  universities.
  969         (d)Phi Beta Sigma Fraternity, Inc.—The department shall
  970  retain all annual use fees from the sale of such plates until
  971  all startup costs for developing and issuing plates have been
  972  recovered. Thereafter, the annual use fees from the sale of the
  973  plate shall be distributed as follows:
  974         1.Ten percent shall be distributed to TmB Charitable
  975  Foundation, Inc., a charitable, not-for-profit organization
  976  under s. 501(c)(3) of the Internal Revenue Code registered with
  977  the Department of Agriculture and Consumer Services and
  978  incorporated in Florida, strictly for marketing the Phi Beta
  979  Sigma Fraternity, Inc., license plate.
  980         2.Eighty-five percent shall be distributed to the TmB
  981  Charitable Foundation, Inc., to promote community awareness and
  982  action through educational, economic, and cultural service
  983  activities.
  984         3.Five percent shall be distributed to the United Negro
  985  College Fund to be used for college scholarships for Florida
  986  residents attending historically black colleges and
  987  universities.
  988         (e)Zeta Phi Beta Sorority, Inc.—The department shall
  989  retain all annual use fees from the sale of such plates until
  990  all startup costs for developing and issuing plates have been
  991  recovered. Thereafter, the annual use fees from the sale of the
  992  plate shall be distributed as follows:
  993         1.Ten percent shall be distributed to Florida Pearls,
  994  Inc., a charitable, not-for-profit organization under s.
  995  501(c)(3) of the Internal Revenue Code registered with the
  996  Department of Agriculture and Consumer Services and incorporated
  997  in Florida, strictly for marketing the Zeta Phi Beta Sorority,
  998  Inc., license plate.
  999         2.Eighty-five percent shall be distributed to Florida
 1000  Pearls, Inc., to promote community awareness and action through
 1001  educational, economic, and cultural service activities.
 1002         3.Five percent shall be distributed to the United Negro
 1003  College Fund to be used for college scholarships for Florida
 1004  residents attending historically black colleges and
 1005  universities.
 1006         (f)Delta Sigma Theta Sorority, Inc.—The department shall
 1007  retain all annual use fees from the sale of such plates until
 1008  all startup costs for developing and issuing plates have been
 1009  recovered. Thereafter, the annual use fees from the sale of the
 1010  plate shall be distributed as follows:
 1011         1.Ten percent shall be distributed to Delta Research and
 1012  Educational Foundation, a charitable, not-for-profit
 1013  organization under s. 501(c)(3) of the Internal Revenue Code,
 1014  strictly for marketing the Delta Sigma Theta Sorority, Inc.,
 1015  license plate.
 1016         2.Eighty-five percent shall be distributed to Delta
 1017  Research and Educational Foundation to promote community
 1018  awareness and action through educational, economic, and cultural
 1019  service activities.
 1020         3.Five percent shall be distributed to the United Negro
 1021  College Fund to be used for college scholarships for Florida
 1022  residents attending historically black colleges and
 1023  universities.
 1024         (g)Alpha Kappa Alpha Sorority, Inc.—The department shall
 1025  retain all annual use fees from the sale of such plates until
 1026  all startup costs for developing and issuing plates have been
 1027  recovered. Thereafter, the annual use fees from the sale of the
 1028  plate shall be distributed as follows:
 1029         1.A maximum of 10 percent shall be distributed to Alpha
 1030  Kappa Alpha Sorority Foundation, Inc., a charitable, not-for
 1031  profit organization under s. 501(c)(3) of the Internal Revenue
 1032  Code registered with the Department of Agriculture and Consumer
 1033  Services and incorporated in Florida, for administrative costs
 1034  and marketing the Alpha Kappa Alpha Sorority, Inc., license
 1035  plate.
 1036         2.The balance of the fees shall be used to supplement the
 1037  Alpha Kappa Alpha Educational Advancement Foundation, Inc.,
 1038  budgets and to promote lifelong learning by awarding
 1039  scholarships, fellowships, and grants.
 1040         (h)Sigma Gamma Rho Sorority, Inc.—The department shall
 1041  retain all annual use fees from the sale of such plates until
 1042  all startup costs for developing and issuing plates have been
 1043  recovered. Thereafter, the annual use fees from the sale of the
 1044  plate shall be distributed as follows:
 1045         1.Ten percent shall be distributed to National Education
 1046  Fund, Inc., a charitable, not-for-profit organization under s.
 1047  501(c)(3) of the Internal Revenue Code, strictly for marketing
 1048  the Sigma Gamma Rho Sorority, Inc., license plate.
 1049         2.Eighty-five percent shall be distributed to National
 1050  Education Fund, Inc., to promote community awareness and action
 1051  through educational, economic, and cultural service activities.
 1052         3.Five percent shall be distributed to the United Negro
 1053  College Fund to be used for college scholarships for Florida
 1054  residents attending historically black colleges and
 1055  universities.
 1056         (102) PLAY BALL LICENSE PLATES.—
 1057         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
 1058  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
 1059  and s. 45, chapter 2014-216, Laws of Florida, the department
 1060  shall develop a Play Ball license plate as provided in this
 1061  section and s. 320.08053. Play Ball license plates must bear the
 1062  colors and design approved by the department. The word “Florida”
 1063  must appear at the top of the plate, and the words “Play Ball”
 1064  must appear at the bottom of the plate.
 1065         (b) The license plate annual use fees shall be distributed
 1066  to American Dream Baseball, Inc., which may retain all proceeds
 1067  from the annual use fees until the startup costs for developing
 1068  and issuing the license plates have been recovered. Thereafter,
 1069  American Dream Baseball, Inc., may use the proceeds as follows:
 1070         1. A maximum of 15 percent may be used for administrative
 1071  costs of the organization associated with implementing the
 1072  programs funded by proceeds derived from sales of the specialty
 1073  license plate.
 1074         2. A maximum of 10 percent may be used for promotion and
 1075  marketing costs of the license plate.
 1076         3. The remainder shall be used to fund the activities,
 1077  programs, and projects of American Dream Baseball, Inc.
 1078         (103) MEDICAL PROFESSIONALS WHO CARE.—
 1079         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
 1080  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
 1081  and s. 45, chapter 2014-216, Laws of Florida, the department
 1082  shall develop a Medical Professionals Who Care license plate as
 1083  provided in this section and s. 320.08053. The plate must bear
 1084  the colors and design approved by the department. The word
 1085  “Florida” must appear at the top of the plate, and the words
 1086  “Medical Professionals Who Care” must appear at the bottom of
 1087  the plate.
 1088         (b) The department shall retain all annual use fees from
 1089  the sale of the plate until all startup costs for developing and
 1090  issuing the plate have been recovered. Thereafter, the annual
 1091  use fees from the sale of the plate shall be distributed to
 1092  Florida Benevolent Group, Inc., a Florida nonprofit corporation,
 1093  which may use up to 10 percent of such fees for administrative
 1094  costs and marketing of the plate. The balance of the fees shall
 1095  be used by Florida Benevolent Group, Inc., to assist low income
 1096  individuals in obtaining a medical education and career through
 1097  scholarships, support, and guidance.
 1098         (104) GO GREEN LICENSE PLATES.—
 1099         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
 1100  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
 1101  and s. 45, chapter 2014-216, Laws of Florida, the department
 1102  shall develop a Go Green license plate as provided in this
 1103  section and s. 320.08053. Go Green license plates must bear the
 1104  colors and design approved by the department. The word “Florida”
 1105  must appear at the top of the plate, and the words “Go Green”
 1106  must appear at the bottom of the plate.
 1107         (b) The annual use fees shall be distributed to the
 1108  Coalition for Renewable Energy Solutions, Inc., which may retain
 1109  all proceeds from the annual use fees until the startup costs
 1110  for developing and issuing the license plates have been
 1111  recovered. Thereafter, Coalition for Renewable Energy Solutions,
 1112  Inc., may use the proceeds as follows:
 1113         1. A maximum of 15 percent may be used for administrative
 1114  costs of the organization associated with implementing the
 1115  programs funded by proceeds derived from sales of the specialty
 1116  license plate.
 1117         2. A maximum of 10 percent may be used for promotion and
 1118  marketing costs of the license plate.
 1119         3. The remainder shall be used to fund the activities,
 1120  programs, and projects of Coalition for Renewable Energy
 1121  Solutions, Inc., that educate, implement, or publicize renewable
 1122  energy solutions and encourage a cleaner and safer environmental
 1123  future for Floridians.
 1124         (105) NATIONAL WILD TURKEY FEDERATION LICENSE PLATES.—
 1125         (a) Notwithstanding s. 45, chapter 2008-176, Laws of
 1126  Florida, as amended by s. 21, chapter 2010-223, Laws of Florida,
 1127  and s. 45, chapter 2014-216, Laws of Florida, the department
 1128  shall develop a National Wild Turkey Federation license plate as
 1129  provided in this section and s. 320.08053. The plate must bear
 1130  the colors and design approved by the department. The word
 1131  “Florida” must appear at the top of the plate, and the words
 1132  “National Wild Turkey Federation” must appear at the bottom of
 1133  the plate.
 1134         (b) The department shall retain all annual use fees from
 1135  the sale of such plates until all startup costs for developing
 1136  and issuing the plates have been recovered. Thereafter, the
 1137  license plate annual use fees shall be distributed to the
 1138  Florida State Chapter of the National Wild Turkey Federation, a
 1139  501(c)(3) citizen support organization created for education and
 1140  scientific research on and the conservation, preservation, and
 1141  restoration of Florida’s wild turkeys.
 1142         (c) At least 75 percent of the funds received by the
 1143  Florida State Chapter of the National Wild Turkey Federation
 1144  must be used to fund programs and projects within the state that
 1145  promote conservation or that improve or increase turkey wildlife
 1146  habitat. To the extent feasible, turkey wildlife habitat
 1147  projects shall be coordinated with the Florida Fish and Wildlife
 1148  Conservation Commission. Up to 25 percent of the funds received
 1149  by the Florida State Chapter of the National Wild Turkey
 1150  Federation may be used for marketing of the license plate, for
 1151  promotion and education regarding this state’s hunting heritage,
 1152  and for administrative costs directly associated with operation
 1153  of the chapter.
 1154         Section 6. Except as otherwise expressly provided in this
 1155  act, this act shall take effect July 1, 2015.
