Florida Senate - 2014 SB 890 By Senator Galvano 26-01418-14 2014890__ 1 A bill to be entitled 2 An act relating to bingo; amending s. 849.0931, F.S.; 3 specifying that ch. 849, F.S., does not prohibit 4 certain park or recreation districts from conducting 5 bingo; authorizing bingo to be held on the premises of 6 certain park or recreation districts; providing an 7 effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsection (4) and paragraph (e) of subsection 12 (11) of section 849.0931, Florida Statutes, are amended to read: 13 849.0931 Bingo authorized; conditions for conduct; 14 permitted uses of proceeds; limitations.— 15 (4) This chapter does not prohibitThe right ofa 16 condominium association, a cooperative association, a 17 homeowners’ association as defined in s. 720.301, a mobile home 18 owners’ association, a group of residents of a mobile home park 19 as defined in chapter 723, a park or recreation district that is 20 an independent special district as defined in s. 189.403, a 21 recreation district as defined in chapter 418, or a group of 22 residents of a mobile home park or recreational vehicle park as 23 defined in chapter 513 from conductingto conductbingo ifis24conditioned upon the return ofthe net proceeds from such games 25 are returned to players in the form of prizes after the 26 deduction ofhaving deductedthe actual business expenses for 27 such games for articles designed for and essential to the 28 operation, conduct, and playing of bingo. Any net proceeds 29 remaining after paying prizes may be donated by the association 30 to a charitable, nonprofit, or veterans’ organization which is 31 exempt from federal income tax under the provisions of s. 501(c) 32 of the Internal Revenue Code to be used in such recipient 33 organization’s charitable, civic, community, benevolent, 34 religious, or scholastic works or similar activities or, in the 35 alternative, such remaining proceeds shall be used as specified 36 in subsection (3). 37 (11) Bingo games or instant bingo may be held only on the 38 following premises: 39 (e) With respect to bingo games conducted by a condominium 40 association, a cooperative association, a homeowners’ 41 association as defined in s. 720.301, a mobile home owners’ 42 association, a group of residents of a mobile home park as 43 defined in chapter 723, a park or recreation district that is an 44 independent special district as defined in s. 189.403, a 45 recreation district as defined in chapter 418, or a group of 46 residents of a mobile home park or recreational vehicle park as 47 defined in chapter 513, property owned by the association, 48 property owned by the residents of the mobile home park or 49 recreational vehicle park, or property which is a common area 50 located within the condominium, mobile home park, or 51 recreational vehicle park, property owned by a park or 52 recreation district that is an independent special district as 53 defined in s. 189.403, or property owned by a recreation 54 district as defined in chapter 418. 55 Section 2. This act shall take effect July 1, 2014.
