2 | An act relating to public swimming pools and spas; |
3 | creating s. 514.0315, F.S.; requiring public swimming |
4 | pools and spas to be equipped with certain safety |
5 | features; providing an effective date. |

7 | Be It Enacted by the Legislature of the State of Florida: |
8 | |
9 | Section 1. Section 514.0315, Florida Statutes, is created |
10 | to read: |
11 | 514.0315 Required safety features for public swimming |
12 | pools and spas.- |
13 | (1) A public swimming pool or spa must be equipped with an |
14 | anti-entrapment system or device that complies with American |
15 | Society of Mechanical Engineers/American National Standards |
16 | Institute standard A112.19.8, or any successor standard. |
17 | (2) A public swimming pool or spa with a single main drain |
18 | other than an unblockable drain must be equipped with at least |
19 | one of the following features that complies with any American |
20 | Society of Mechanical Engineers, American National Standards |
21 | Institute, American Standard for Testing and Materials, or other |
22 | applicable consumer product safety standard for such system or |
23 | device: |
24 | (a) A safety vacuum release system that ceases operation |
25 | of the pump, reverses the circulation flow, or otherwise |
26 | provides a vacuum release at a suction outlet when a blockage is |
27 | detected and that has been tested by an independent third party |
28 | and found to conform to American Society of Mechanical |
29 | Engineers/American National Standards Institute standard |
30 | A112.19.17, American Standard for Testing and Materials standard |
31 | F2387, or any successor standard. |
32 | (b) A suction-limiting vent system with a tamper-resistant |
33 | atmospheric opening. |
34 | (c) A gravity drainage system that uses a collector tank. |
35 | (d) An automatic pump shut-off system. |
36 | (e) A device or system that disables the drain. |
37 | (3) The determination and selection of a feature under |
38 | subsection (2) for a public swimming pool or spa constructed |
39 | before January 1, 1993, is at the sole discretion of the owner |
40 | or operator of the public swimming pool or spa. |
41 | Section 2. This act shall take effect July 1, 2011. |
