A bill to be entitled
2An act relating to public swimming pools and spas;
3creating s. 514.0315, F.S.; requiring public swimming
4pools and spas to be equipped with certain safety
5features; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:
8
9     Section 1.  Section 514.0315, Florida Statutes, is created
10to read:
11     514.0315  Required safety features for public swimming
12pools and spas.-
13     (1)  A public swimming pool or spa must be equipped with an
14anti-entrapment system or device that complies with American
15Society of Mechanical Engineers/American National Standards
16Institute standard A112.19.8, or any successor standard.
17     (2)  A public swimming pool or spa with a single main drain
18other than an unblockable drain must be equipped with at least
19one of the following features that complies with any American
20Society of Mechanical Engineers, American National Standards
21Institute, American Standard for Testing and Materials, or other
22applicable consumer product safety standard for such system or
23device:
24     (a)  A safety vacuum release system that ceases operation
25of the pump, reverses the circulation flow, or otherwise
26provides a vacuum release at a suction outlet when a blockage is
27detected and that has been tested by an independent third party
28and found to conform to American Society of Mechanical
29Engineers/American National Standards Institute standard
30A112.19.17, American Standard for Testing and Materials standard
31F2387, or any successor standard.
32     (b)  A suction-limiting vent system with a tamper-resistant
33atmospheric opening.
34     (c)  A gravity drainage system that uses a collector tank.
35     (d)  An automatic pump shut-off system.
36     (e)  A device or system that disables the drain.
37     (3)  The determination and selection of a feature under
38subsection (2) for a public swimming pool or spa constructed
39before January 1, 1993, is at the sole discretion of the owner
40or operator of the public swimming pool or spa.
41     Section 2.  This act shall take effect July 1, 2011.
