1	A bill to be entitled
2	An act relating to biomedical research; repealing s.
3	381.0404, F.S., relating to the Center for Health
4	Technologies; repealing s. 381.85, F.S., relating to the
5	Florida Biomedical and Social Research Act; amending s.
6	381.855, F.S., relating to the Florida Center for
7	Universal Research to Eradicate Disease; revising advisory
8	council membership to conform to changes made by the act;
9	repealing s. 381.912, F.S., relating to the Cervical
10	Cancer Elimination Task Force; repealing s. 381.92, F.S.,
11	relating to the Florida Cancer Council; transferring and
12	amending s. 381.921, F.S., relating to the mission and
13	duties of Florida Cancer Council, to conform to changes
14	made by the act; amending s. 381.922, F.S., relating to
15	the William G. "Bill" Bankhead, Jr., and David Coley
16	Cancer Research Program, to conform to changes made by the
17	act; providing an effective date.

19	Be It Enacted by the Legislature of the State of Florida:
20
21	Section 1. Section 381.0404, Florida Statutes, is
22	repealed.
23	Section 2. Section 381.85, Florida Statutes, is repealed.
24	Section 3. Paragraph (a) of subsection (5) of section
25	381.855, Florida Statutes, is amended to read:
26	381.855 Florida Center for Universal Research to Eradicate
27	Disease.-
28	(5) There is established within the center an advisory
29	council that shall meet at least annually.
30	(a) The council shall consist of one representative from a
31	Florida not-for-profit institution engaged in basic and clinical
32	biomedical research and education which receives more than $10
33	million in annual grant funding from the National Institutes of
34	Health, to be appointed by the State Surgeon General from a
35	different institution each term, and one representative from and
36	appointed by each of the following entities:
37	1. Enterprise Florida, Inc.
38	2. BioFlorida.
39	3. The Biomedical Research Advisory Council.
40	4. The Florida Medical Foundation.
41	5. Pharmaceutical Research and Manufacturers of America.
42	6. The Florida Cancer Council.
43	6.7. The American Cancer Society, Florida Division, Inc.
44	7.8. The American Heart Association.
45	8.9. The American Lung Association of Florida.
46	9.10. The American Diabetes Association, South Coastal
47	Region.
48	10.11. The Alzheimer's Association.
49	11.12. The Epilepsy Foundation.
50	12.13. The National Parkinson Foundation.
51	13.14. The Florida Public Health Institute, Inc.
52	14.15. The Florida Research Consortium.
53	Section 4. Section 381.912, Florida Statutes, is repealed.
54	Section 5. Section 381.92, Florida Statutes, is repealed.
55	Section 6. Subsections (2) and (5) of section 381.922,
56	Florida Statutes, are amended, and section 381.921, Florida
57	Statutes is transferred to paragraph (a) of subsection (2) of
58	that section and amended, to read:
59	381.922 William G. "Bill" Bankhead, Jr., and David Coley
60	Cancer Research Program.-
61	(2) The program shall provide grants for cancer research
62	to further the search for cures for cancer.
63	(a) Emphasis shall be given to the following goals
64	enumerated in s. 381.921, as those goals support the advancement
65	of such cures:.
66	381.921 Florida Cancer Council mission and duties.-The
67	council, which shall work in concert with the Florida Center for
68	Universal Research to Eradicate Disease to ensure that the goals
69	of the center are advanced, shall endeavor to dramatically
70	improve cancer research and treatment in this state through:
71	1.(1) Efforts to significantly expand cancer research
72	capacity in the state by:
73	a.(a) Identifying ways to attract new research talent and
74	attendant national grant-producing researchers to cancer
75	research facilities in this state;
76	b.(b) Implementing a peer-reviewed, competitive process to
77	identify and fund the best proposals to expand cancer research
78	institutes in this state;
79	c.(c) Funding through available resources for those
80	proposals that demonstrate the greatest opportunity to attract
81	federal research grants and private financial support;
82	d.(d) Encouraging the employment of bioinformatics in
83	order to create a cancer informatics infrastructure that
84	enhances information and resource exchange and integration
85	through researchers working in diverse disciplines, to
86	facilitate the full spectrum of cancer investigations;
87	e.(e) Facilitating the technical coordination, business
88	development, and support of intellectual property as it relates
89	to the advancement of cancer research; and
90	f.(f) Aiding in other multidisciplinary research-support
91	activities as they inure to the advancement of cancer research.
92	2.(2) Efforts to improve both research and treatment
93	through greater participation in clinical trials networks by:
94	a.(a) Identifying ways to increase adult enrollment in
95	cancer clinical trials;
96	b.(b) Supporting public and private professional education
97	programs designed to increase the awareness and knowledge about
98	cancer clinical trials;
99	c.(c) Providing tools to cancer patients and community-
100	based oncologists to aid in the identification of cancer
101	clinical trials available in the state; and
102	d.(d) Creating opportunities for the state's academic
103	cancer centers to collaborate with community-based oncologists
104	in cancer clinical trials networks.
105	3.(3) Efforts to reduce the impact of cancer on disparate
106	groups by:
107	a.(a) Identifying those cancers that disproportionately
108	impact certain demographic groups; and
109	b.(b) Building collaborations designed to reduce health
110	disparities as they relate to cancer.
111	(b) Preference may be given to grant proposals that foster
112	collaborations among institutions, researchers, and community
113	practitioners, as such proposals support the advancement of
114	cures through basic or applied research, including clinical
115	trials involving cancer patients and related networks.
116	(5) Funds appropriated for the William G. "Bill" Bankhead,
117	Jr., and David Coley Cancer Research Program shall be
118	distributed pursuant to this section to provide grants to
119	researchers seeking cures for cancer and cancer-related
120	illnesses, with emphasis given to the goals enumerated in this
121	section s. 381.921. From the total funds appropriated, an amount
122	of up to 10 percent may be used for administrative expenses. In
123	the 2009-2010 fiscal year, 2.5 percent, not to exceed $25
124	million, of the revenue deposited into the Health Care Trust
125	Fund pursuant to s. 215.5602(12)(a) shall be transferred to the
126	Biomedical Research Trust Fund within the Department of Health
127	for the William G. "Bill" Bankhead, Jr., and David Coley Cancer
128	Research Program.
129	Section 7. This act shall take effect July 1, 2010.
