2 | An act relating to transportation concurrency exceptions; |

4 | assembly or manufacture of aircraft within a list of |
5 | public transit facilities exempt from application of |
6 | certain transportation concurrency requirements; providing |
7 | an effective date. |

9 | Be It Enacted by the Legislature of the State of Florida: |

11 | Section 1. Paragraph (b) of subsection (4) of section |
12 | 163.3180, Florida Statutes, is amended to read: |
13 | 163.3180 Concurrency.-- |
14 | (4) |
15 | (b) The concurrency requirement as implemented in local |
16 | comprehensive plans does not apply to public transit facilities. |
17 | For the purposes of this paragraph, public transit facilities |
18 | include transit stations and terminals; transit station parking; |
19 | park-and-ride lots; intermodal public transit connection or |
20 | transfer facilities; fixed bus, guideway, and rail stations; and |
21 | airport passenger terminals and concourses, air cargo |
22 | facilities, and hangars for the assembly, manufacture, |
23 | maintenance, or storage of aircraft. As used in this paragraph, |
24 | the terms "terminals" and "transit facilities" do not include |
25 | seaports or commercial or residential development constructed in |
26 | conjunction with a public transit facility. |
27 | Section 2. This act shall take effect July 1, 2010. |
