A bill to be entitled
2An act relating to cost and benefit analysis of
3legislation; creating s. 216.138, F.S.; authorizing the
4President of the Senate or Speaker of the House of
5Representatives to request special impact sessions of the
6Revenue Estimating Conference to consider the costs and
7benefits of proposed legislation; establishing timeframes;
8requiring the Office of Economic and Demographic Research
9and other principals to develop protocols and procedures;
10establishing minimum requirements; requiring submission of
11a report; requiring utilization of protocols and
12procedures until the approval is affirmatively revoked;
13providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Section 216.138, Florida Statutes, is created
18to read:
19 216.138 Cost and benefit analysis of legislation.--The
20President of the Senate or the Speaker of the House of
21Representatives may request special impact sessions of the
22Revenue Estimating Conference to consider both the costs and
23benefits of proposed legislation. The request must be made at
24least 90 days before the beginning of the subsequent legislative
25session, and the information developed by the Revenue Estimating
26Conference shall be completed no later than the start of the
27legislative session for which it is requested. The information
28used to develop the analyses shall be available to the public.
29 Section 2. The Office of Economic and Demographic
30Research, acting in consultation with the principals of the
31Revenue Estimating Conference, and after receiving public input,
32shall by October 1, 2010, develop protocols and procedures for
33the consistent estimation of costs and benefits of specific
34proposed legislation. At a minimum, the protocols and procedures
35must address appropriate economic techniques used in the
36analysis of proposed legislation, the format for reporting
37results, and proposed linkages to the appropriations and revenue
38forecasting processes, including any statutory changes that
39would be needed. The linkages must be consistent with the
40constitutional requirement to have a balanced budget. The office
41shall submit a report of its findings and recommendations to the
42President of the Senate and Speaker of the House of
43Representatives by October 1, 2010. Subject to approval by the
44President of the Senate and Speaker of the House of
45Representatives following the submission of the report, the
46protocols and procedures shall be utilized for the analysis of
47specific proposed legislation by the Revenue Estimating
48Conference as provided in s. 216.138, Florida Statutes, unless
49and until such approval is subsequently affirmatively revoked.
50 Section 3. This act shall take effect upon becoming a law.
