DELAWARE STATE SENATE

145th GENERAL ASSEMBLY

SENATE BILL NO. 252

AN ACT TO AMEND CHAPTER 49, TITLE 9 OF THE DELAWARE CODE RELATING TO ZONING.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §4926, Chapter 49, Title 9 of the Delaware Code by deleting the language in its entirety and replacing it with the following:

"With respect to any proposed zoning change, unless the owner applies for the change or consents to the change, the county government shall provide written notice to the owner of the property at least 7 days prior to the initial hearing upon such zoning change."

Section 2.This Act shall take effect immediately.

SYNOPSIS

Currently, Title 9 requires Kent County to notify property owners subject to a proposed zoning change by U.S. mail, publication in newspapers and physically posting changes at each property affected.This Act deletes the requirement of physical postings for proposed zoning changes.
