HOUSE CONCURRENT RESOLUTION NO. 43

REQUESTING THE OFFICE OF MANAGEMENT AND BUDGET AND THE DELAWARE ECONOMIC DEVELOPMENT OFFICE TO EVALUATE THE FEASIBILITY OF APPLYING A CREDIT FOR MANUFACTURERS LOCATED IN DELAWARE IN DESIGNATING STATE CONTRACT VENDORS AND ELIMINATING CERTAIN CONTRACT REQUIREMENTS.



WHEREAS, the State of Delaware purchases many products from selected State contract vendors; and

WHEREAS, any manufacturer located in Delaware, employing Delaware citizens and paying Delaware taxes, should be encouraged by State policy to grow and expand whenever reasonably possible; and

WHEREAS, the State, in selecting State contract vendors, does not apply a credit for Delaware manufacturers; and WHEREAS, there have been instances of Delaware manufacturers offering to State agencies the same or similar product for less than the State contract price, but the agencies are required to go back to the contract vendor and request them to match the lower offer; and

WHEREAS, requiring State agencies to go back to the contract vendor puts the Delaware manufacturer at a disadvantage; and

WHEREAS, a credit to a Delaware manufacturers could be beneficial to the people of Delaware;

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives of the 146th General Assembly of the State of Delaware, the Senate concurring therein, that the Office of Management and Budget and the Delaware Economic Development Office are requested to evaluate the State contract vendor selection process and determine the feasibility of applying a credit for manufacturers located in Delaware and to additionally consider eliminating the State contract provisions that mandate the selected vendor be given the opportunity to match or beat an offer from a Delaware vendor that offers a verified similar and less expensive product.

BE IT FURTHER RESOLVED that suitably prepared copies of this resolution be presented to the Director of the Office of Management and Budget and the Secretary of the Delaware Economic Development Office.


SYNOPSIS

This resolution requests that the Office of Management and Budget and the Delaware Economic Development Office research the potential of applying a credit in the application consideration process when selecting vendors to be approved and designated a State contract specified vendor.This consideration and/or credit in the process will recognize that the applicant vendor is a Delaware manufacturer located in Delaware and making a Delaware product and providing employment within the State.
