HOUSE BILL NO. 17

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO STATE PROCUREMENT.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §6902, Title 29 of the Delaware Code by renumbering subsections (26), (27), and (28) as (28), (29), and (30), and adding new subsections (26) and (27) as follows:

"(29) ‘Veteran' means a resident of this State who served in the active military, national guard, or reserve forces, and who was discharged or released therefrom under conditions other than dishonorable.

(30)‘Veteran-Owned Small Business' means a small business that is at least 51% owned and controlled by one or more individuals who are veterans.".

Section 2.Amend Title 29 of the Delaware Code by adding a new §6909B as follows:

"§6909B Veteran-Owned Business.

(a)It is the goal of the State to award each year not less than 3% of its total expenditures for materiel, public works contracts, and services to veteran-owned small businesses.The State may count toward its 3% yearly goal described in this subsection that portion of all contracts in which the successful bidder subcontracts with a veteran-owned small business.

(b) Each year, the Office of Management and Budget shall report to both the Senate and House Veteran Affairs Committee of the General Assembly on all of the following:

(1)The number of veteran-owned small businesses that submitted a bid for a state procurement contract;

(2)The number of veteran-owned small businesses who entered into procurement contracts with the state and the total value of those contracts; and

(3)Whether the state achieved the goal described in this subsection.".


SYNOPSIS

This bill sets a goal that 3% of Delaware purchasing dollars be spent with disabled veteran-owned and veteran-owned businesses in Delaware.This bill recognizes the extraordinary service rendered by veterans to our State and the United States and encourages the improvement of business opportunities in State contracting and procurement for veteran-owned small businesses.
