AN ACT PROHIBITING SPOOFING AND CRAMMING.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2011) (a) As used in this section, "telephone" means any device used by a person for voice communications in connection with the services of a telephone company, whether such voice communications are transmitted in analog, data or any other form, and "telephone company" means any company that provides commercial telephone services, irrespective of the communications technology used to provide such service, including, but not limited to, traditional wireline or cable telephone service, cellular, broadband PCS or other wireless telephone service, microwave, satellite or other terrestrial telephone service and voice over Internet telephone service.

(b) No person shall use any device to change the name or telephone number on a caller identification display on the telephone that such person is calling with the intent to defraud or cause harm to another. This subsection shall not prohibit (1) any shelter facility for victims of domestic violence from using such a device, or (2) any person from using a call blocking service provided by such person's telephone company.

(c) A violation of the provisions of this section shall be deemed an unfair or deceptive trade practice under subsection (a) of section 42-110b of the general statutes.

Sec. 2. (NEW) (Effective October 1, 2011) (a) No telecommunications company, as defined in section 16-1 of the general statutes, shall charge a customer for any telecommunications service without the authorization of the customer to receive and be charged for such service.

(b) A violation of the provisions of this section shall be deemed an unfair or deceptive trade practice under subsection (a) of section 42-110b of the general statutes.

This act shall take effect as follows and shall amend the following sections:
