AN ACT CONCERNING SHAKEN BABY SYNDROME.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2013) (a) As used in this section, "infant or young child" means any child three years of age or younger, and "shaken baby syndrome" means damage to the brain of an infant or young child, including, but not limited to, swelling that impedes the supply of oxygen to the brain or any degree of brain damage that results from the infant or young child having been forcefully shaken.

(b) Any individual who intentionally shakes or causes to be shaken an infant or young child causing injuries consistent with shaken baby syndrome shall be guilty of a class C felony, except that if death results such individual shall be guilty of a class B felony.

This act shall take effect as follows and shall amend the following sections:

To increase the criminal penalty for causing injuries resulting in shaken baby syndrome.
