An act to add Chapter 7 (commencing with Section 6880) to Part 1 of Division 6 of the Elections Code, relating to elections.

Existing law establishes processes for printing on presidential primary ballots the names of candidates for President of the United States who are considered to be generally recognized candidates or who are selected by a sufficient number of registered voters. Existing law generally requires a write-in candidate for President in a presidential primary election to file an endorsement of his or her write-in candidacy with the Secretary of State, at least 21 days before the election.
This bill would enact the Presidential Tax Transparency and Accountability Act, which would require a candidate for President, in order to have his or her name placed upon a primary election ballot, to file his or her income tax returns for the 5 most recent taxable years, if applicable, years with the Secretary of State. The people of the State of California do enact as follows:


SECTION 1.

 Chapter 7 (commencing with Section 6880) is added to Part 1 of Division 6 of the Elections Code, to read:
CHAPTER  7. Income Tax Return Disclosure Requirements

6880.
 This chapter shall be known and may be cited as the Presidential Tax Transparency and Accountability Act.

6881.
 The Legislature finds and declares that a presidential candidate’s income tax returns provide voters with essential information regarding the candidate’s potential conflicts of interest, business dealings, financial status, and charitable donations. Donald Trump’s refusal to release his income tax returns departed from decades of established political tradition, denying voters the opportunity to fully evaluate his fitness for the office of President of the United States.

 For purposes of this chapter, “income tax return” means any tax or information return, declaration of estimated tax, or claim for refund required by, or provided for or permitted under, the provisions of the Internal Revenue Code, and that is filed on behalf of, or with respect to any person, and any amendment or supplement thereto, including supporting schedules, attachments, or lists that are supplemental to, or part of, the return so filed.

 (a) Notwithstanding any other law, the Secretary of State shall not print the name of a candidate for President of the United States on a primary election ballot, unless the candidate, within a reasonable timeframe established by the Secretary of State, files with the Secretary of State a copy of his or her every income tax returns for return the candidate filed with the Internal Revenue Service in the five most recent taxable years, if applicable. years.
