An act to amend Section 60642.6 of the Education Code, relating to pupil assessment.

Pupil assessments: interim assessments and formative assessment tools.
Existing law requires the Superintendent of Public Instruction, the State Board of Education, and any other entity or individual designated by the Governor to participate in the Common Core State Standards Initiative consortium or any related interstate consortium, as specified. Existing law requires the State Department of Education to acquire, and offer at no cost to local educational agencies, interim and formative assessment tools for kindergarten and grades 1 to 12, inclusive, as provided through membership in that consortium. Existing law requires the interim assessments to be designed to provide timely feedback to teachers that they may use to continually adjust instruction to improve pupil learning.
This bill would require formative assessment tools offered pursuant to those provisions to also be designed to provide timely feedback to
teachers that they may use to continually adjust instruction to improve pupil learning. The bill would require the formative assessment tools to include a bank of released the department to ensure that test items from that appeared on prior administrations of the summative assessment, and that are no longer in use, are released for use by teachers, and to ensure, among other things, that the released items are identified by the standard
or standards assessed, and including certain test item types and information, that teachers may embed in their instruction in order to aid in
eliciting, interpreting, and acting on evidence about pupils’ progress. The bill would require the bank of test items to be are accessible online without requiring an account, and to be are presented separately from other formative assessment resources currently produced by the consortium.

The people of the State of California do enact as follows:
SECTION 1.
Section 60642.6 of the Education Code is amended to read:60642.6.
(a) The department shall acquire, and offer at no cost to local educational agencies, interim assessments and formative assessment tools for kindergarten and grades 1 to 12, inclusive, as provided through the consortium membership pursuant to Section 60605.7. The interim assessments and formative assessment tools shall be designed to provide timely feedback to teachers that they may use, in combination with other sources of information they have about their pupils’ progress, to continually adjust instruction to improve learning.(b) A local educational agency that elects to use the interim assessments provided for under this section shall ensure that teachers who administer the
assessments have access to all functions and information which that are designed for teacher use and which that relate to the assessments and pupil performance on the assessments.
(c) All interim assessments offered pursuant to this section shall be developed in close consultation with current classroom teachers at each grade level assessed for the purpose of soliciting feedback regarding the capacity of the interim assessments to provide timely feedback to allow teachers to continually adjust
instruction to improve learning.
(d) The formative assessment tools required to be offered by the department pursuant to this section shall include a bank of released test items from department shall ensure that test items that appeared on prior administrations of the summative assessment produced by the consortium, that teachers may embed in their instruction in order to aid in eliciting, interpreting, and acting on evidence about pupils’ progress. The bank of test items shall identify items by the standard assessed. The bank of test items shall be accessible online without requiring an account, and shall be presented separately from other formative assessment resources currently produced by the consortium. The bank of test items shall include, but not be limited to, all of the following:
assessment, and that are no longer in use, are released for use by teachers. The department, in regards to released test items, shall ensure all of the following:
(1) A significant number of the items that appeared on all prior
administrations of the summative assessment, assessment are made available, including items for each grade level and subject assessed.
(2) A variety of item types, including performance tasks, in proportion to the item types found on the summative assessment. are made available.
(3) Scoring rubrics, guides to scoring, answer keys, and scored and
annotated sample pupil responses. responses produced by the consortium are made available.
(4) The items are identified by the standard or standards assessed.
(5) The items are accessible online without requiring an account, and are presented separately from other formative assessment resources currently produced by the consortium. The items may be presented as part of the practice and training resources provided by the consortium.
