   An act to add Sections 60905, 60905.1, 60905.2, and 60905.3 to the
Education Code, relating to public school instruction.

   AB 2265, as introduced, Salas. Pupil achievement: California
Longitudinal Pupil Achievement Data System.
   Existing law requires the State Department of Education to
contract for the development of proposals that will provide for the
retention and analysis of longitudinal pupil achievement data on the
STAR Program, English language development tests, and the high school
exit examination, known as the California Longitudinal Pupil
Achievement Data System.
   This bill would require the department to allocate specified
funding, subject to funds being appropriated in the annual Budget
Act, as part of a local data management support program, to local
educational agencies and direct-funded charter schools that complete
specified acts. Local educational agencies and direct-funded charter
schools would be limited in the use of these funds for specified
activities.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 60905 is added to the Education Code, to read:
   60905.  The Legislature finds and declares all of the following:
   (a) California's multibillion dollar educational enterprise for
kindergarten and grades 1 to 12, inclusive, of California is held
accountable based on data received from local educational agencies.
   (b) National and state educational reform efforts revolve around
using data at both the state and local levels to inform better
decisions.
   (c) The feasibility study report developed pursuant to subdivision
(a) of Section 60900 found that poor quality data submitted by local
educational agencies is a high impact risk to the California
Longitudinal Pupil Achievement Data System.
   (d) The California Longitudinal Pupil Achievement Data System can
provide more accurate graduation and dropout rate information if
local educational agencies and direct-funded charter schools provide
quality data to the system through statewide pupil identifiers.
  SEC. 2.  Section 60905.1 is added to the Education Code, to read:
   60905.1.  It is the intent of the Legislature to support local
educational agency data management activities to enhance the quality
of the data that is used locally and submitted to meet state and
federal reporting and accountability requirements.
  SEC. 3.  Section 60905.2 is added to the Education Code, to read:
   60905.2.  (a) In order to support the requirements specified in
subdivision (e) of Section 60900, local educational agencies and
direct-funded charter schools may receive a local data management
support program annual grant, subject to funds being appropriated for
this purpose in the annual Budget Act, as follows:
   (1) Local educational agencies and direct-funded charter schools
with enrollment of between 1 and 1,000 shall receive five thousand
dollars ($5,000) annually.
   (2) Local educational agencies and direct-funded charter schools
with enrollment of 1,001 or greater shall receive at least five
dollars ($5) per pupil enrolled within the agency, based on the
annual enrollment update for the prior year, as certified by the
department.
   (3) For purposes of this section, the following definitions apply:

   (A) "Direct-funded charter school" means a charter school that
elects to receive its funding directly pursuant to Section 47651.
   (B) "Enrollment" means enrollment certified in the prior year for
the California Basic Education Data System.
   (4) If funds appropriated in the annual Budget Act are
insufficient to provide full funding to implement this section, the
department shall prorate the rates specified in paragraphs (1) and
(2).
   (b) The department shall allocate this funding annually to local
educational agencies and direct-funded charter schools that do all of
the following:
   (1) Resolve anomalies related to the statewide pupil identifier
required by paragraph (5) of subdivision (e) of Section 60900
assigned to enrolled pupils in order to maintain a validity rate
specified by the Superintendent.
   (2) Include the statewide pupil identifier on the transcript of
each pupil.
   (3) Maintain one generic electronic mail address for local data
management or information technology directors or personnel in order
to facilitate communication between the department and the
appropriate personnel of the local educational agency.
  SEC. 4.  Section 60905.3 is added to the Education Code, to read:
   60905.3.  Local educational agencies and direct-funded charter
schools shall use funds received pursuant to Section 60905.2 to
support staff, hardware and software acquisitions, training, and
other activities related to meeting the requirements specified in
subdivision (e) of Section 60900.
