Existing law establishes a public school financing system that requires state funding for county superintendents of schools, school districts, and charter schools to be calculated pursuant to a local control funding formula, as specified. Existing law requires funding pursuant to the local control funding formula to include, in addition to a grade span adjusted base grant, a 10.4% adjustment to the kindergarten and grades 1 to 3, inclusive, base grant for school districts that maintain, or make progress toward, as specified, an average class enrollment of not more than 24 pupils for each schoolsite. requires a school district maintaining a kindergarten to admit a child who will have their 5th birthday on or before September 1
of the school year. Existing law authorizes, under certain circumstances, school districts offering kindergarten to maintain kindergarten classes at different schoolsites for different lengths of time.
This bill would require, from the 2027–28 to the 2029–30 school year, inclusive, as a condition of receiving that portion of the additional adjustment that is based on average daily attendance in kindergarten,
a school district or charter school that has an enrolled unduplicated pupil percentage of 50% or more and offers a kindergarten program, to provide, at each schoolsite that offers a kindergarten program, a minimum of one class that offers a minimum schoolday for the kindergarten day that is at least equivalent to the minimum schoolday provided for grades 1 to 3, inclusive. The bill would apply, impose the same requirement on a school district or charter school, commencing with the 2030–31 school year, the same condition to a school district or charter school, regardless of the enrolled unduplicated pupil percentage. The bill would provide that these provisions do not apply to transitional kindergarten.
By imposing new duties on a school district or charter school the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:
SECTION 1.
Section 46121 is added to the Education Code, immediately following Section 46120, to read:46121.
(a) From the 2027–28 school year to the 2029–30 school year, inclusive, notwithstanding any other law, including Sections 46111 and 46117, a school district or charter school that has an enrolled unduplicated pupil percentage of 50 percent or more and provides a kindergarten program shall offer, at each schoolsite that provides the program, a minimum of one class that offers a minimum schoolday for the kindergarten day that is at least equivalent to the minimum schoolday provided for grades 1 to 3, inclusive.(b) Commencing with the 2030–31 school year, notwithstanding any other law, including Sections 46111 and 46117, a school district or charter school that provides a kindergarten program shall offer, at each schoolsite that provides the
program, a minimum of one class that offers a minimum schoolday for the kindergarten day that is at least equivalent to the minimum schoolday provided for grades 1 to 3, inclusive.
(c) This section does not apply to transitional kindergarten.
