AN ACT
Amending title 33, chapter 4, article 2, Arizona Revised Statutes, by adding section 33-425; Amending title 40, Arizona Revised Statutes, by adding chapter 8; relating to water utilities.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 33, chapter 4, article 2, Arizona Revised Statutes, is amended by adding section 33-425, to read:
33-425. Water utility; written instrument recordation requirements; definition
A. Any written instrument, including an advance in aid of construction agreement, between a developer or builder and a water utility that would require the water utility to repay the developer or builder shall be duly acknowledged and recorded in the county in which the affected property is located.
B. The written instrument shall be recorded with a summary in recordable format that includes the following:
1. The legal description of the affected property.
2. The duration of the agreement between the developer or builder and the water utility.
3. How much the water utility is expected to repay the developer or builder over the term of the agreement.
4. The estimated costs to be borne by the purchaser.
C. For the purposes of this section, "water utility" means a public service corporation that is subject to the corporation commission's jurisdiction and that engages in supplying water utility service in this state.
Sec. 2. Title 40, Arizona Revised Statutes, is amended by adding chapter 8, to read:
CHAPTER 8
WATER UTILITY DISCLOSURES
ARTICLE 1. GENERAL PROVISIONS
40-1301. Water utility; disclosure requirements; definition
A. A water utility shall post on the utility's official website, or provide an annual disclosure to the utility's ratepayers if there is not an official website, the following information in clear and plain language:
1. An estimate of what the water utility plans to spend over the next five years.
2. An estimate of the impact these expenditures will have on the average residential ratepayer.
3. information relating to any written agreement, including an advance in aid of construction agreement, between a developer or builder and the water utility that would require the water utility to repay the developer or builder and what those costs are.
4. An estimate of when the water utility plans to file its next rate case with the commission.
B. For the purposes of this section, "water utility" means a public service corporation that is subject to the corporation commission's jurisdiction and that engages in supplying water utility service in this state.
