AN ACT

Establishing the constable study committee.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Constable study committee; membership; duties; report; delayed repeal

A. The constable study committee is established consisting of the following members:

1. One member of the house of representatives who is appointed by the speaker of the house of representatives and who serves as cochairperson of the committee.

2. One member of the senate who is appointed by the president of the senate and who serves as cochairperson of the committee.

3. Two public members, one of whom is from a county with a population of one million persons or more and who is appointed by the speaker of the house of representatives and one of whom is from a county with a population of less than one million persons and who is appointed by the president of the senate.

4. Two constables, one of whom is from a county with a population of one million persons or more and who is appointed by the president of the senate and one of whom is from a county with a population of less than one million persons and who is appointed by the speaker of the house of representatives.

5. Two justices of the peace, one of whom is from a county with a population of one million persons or more and one of whom is from a county with a population of less than one million persons and both of whom are appointed by the presiding justice of the peace of a county with a population of more than one million persons.

B. The committee shall research and report on the following:

1. Constable duties.

2. Constable salaries.

3. Calculating constable salaries on workload instead of population.

4. Current statutes that regulate constables.

C. The committee may:

1. Request information, data and reports from any constable, county, state agency or political subdivision of this state. If possible, information must be provided electronically. If requested, a constable, county, state agency or political subdivision of this state shall provide the information, data and reports.

2. Hold hearings, conduct fact-finding tours and take testimony from witnesses who may assist the committee in fulfilling its responsibilities.

D. On request of the committee, an agency of this state shall provide to the committee its services, equipment, documents, personnel and facilities to the extent possible without cost to the committee.

E. The legislature shall provide staff and support services to the committee.

F. The committee shall meet at the state capitol or at other places as the cochairpersons deem necessary or convenient, and all meetings must be open to the public.�

G. Members of the committee are not eligible to receive compensation but are eligible for reimbursement of expenses pursuant to title 38, chapter 4, article 2, Arizona Revised Statutes.

H. On or before January 15, 2016, the committee shall submit a report regarding its findings and recommendations to the governor, the speaker of the house of representatives and the president of the senate and provide a copy of its report to the secretary of state.

I. This section is repealed from and after June 30, 2016.
