SENATE BILL 1109

 

 

 

AN ACT

 

amending title 9, chapter 4, article 7, Arizona Revised Statutes, by adding section 9‑471.04; relating to cities and towns.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 7, Arizona Revised Statutes, is amended by adding section 9-471.04, to read:

START_STATUTE9-471.04.  Annexation of territory partially or completely surrounded by city or town

Notwithstanding any other provision of this article:

1.  A city or town located in counties with a population of more than three hundred fifty thousand persons according to the most recent united states decennial census may annex any territory laying within an area that is surrounded by the city or town or that is bordered by the city or town on at least three sides if the landowner has submitted a request to the federal government to take ownership of the territory or hold the territory in trust.

2.  The annexation of territory pursuant to this section is valid if approved by a majority vote of the governing body of the city or town and the annexation becomes immediately final if it is approved as an emergency measure as provided by section 19-142, subsection B.

3.  For the purpose of this subsection, "submitted a request to the federal government" means the landowner has made an application to the federal government as required by a specific federal statute or regulation. END_STATUTE

Sec. 2.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
