SENATE BILL 1109

 

 

 

AN ACT

 

amending title 38, chapter 8, article 1, Arizona Revised Statutes, by adding section 38‑1103; relating to law enforcement officers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 38, chapter 8, article 1, Arizona Revised Statutes, is amended by adding section 38-1103, to read:

START_STATUTE38-1103.  Disciplinary warnings; personnel file; definition

A.  A disciplinary warning, whether oral or written, issued to a law enforcement officer shall not be an appealable agency action.

B.  A disciplinary warning, whether oral or written, issued to a law enforcement officer by the officer's employer shall not be included in the law enforcement officer's personnel file and may be withdrawn after one year at the discretion of the supervisor.

C.  A disciplinary warning, whether written or oral, issued to a law enforcement officer shall not be used to suspend or revoke a law enforcement officer's Arizona peace officers standards training certification.

D.  For the purposes of this section, "law enforcement officer" means:

1.  An individual who is certified by the Arizona peace officer standards and training board, other than a person employed by a multi-county water conservation district, a reserve police officer, a volunteer or a person who is otherwise exempted by an existing merit system.

2.  A correction officer or detention officer, excluding a juvenile detention officer who is employed by this state or a political subdivision of this state.

3.  A regularly appointed and paid deputy sheriff of a county.

4.  A regularly employed police officer in a city or town. END_STATUTE
