proposing an amendment to the Constitution of Arizona; amending article IV, part 2, section 20, Constitution of Arizona; relating to state budgets.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1. Article IV, part 2, section 20, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

CONST20. Appropriation bills; balanced budget; deficits; special session

Section 20. A. The general appropriation bill shall embrace nothing but appropriations for the different departments of the this state, for state institutions, for public schools and for interest on the public debt. All other appropriations shall be made by separate bills, each embracing but one subject.

B. The general appropriation bill shall include a provision that delineates the general fund revenue estimate and the general fund expenditure estimate for the budget fiscal year and the following two fiscal years.  The estimates must be BALANCED for each fiscal year.  The estimates are balanced for a fiscal year if the unreserved general fund beginning balance, together with the general fund revenue estimate for that fiscal year, is equal to or greater than the general fund expenditure estimate for that fiscal year.

C. On the second Friday of October and December of each year, the legislature shall publish a revised estimate of projected general fund revenues and general fund expenditures for the current fiscal year and shall transmit a copy of the revised estimate to the governor and the treasurer. If the revised estimate of projected general fund revenues and GENERAL FUND expenditures indicates that general fund expenditures in the current fiscal year will exceed the estimated general fund revenues by at least two percent, the Legislature may present to the governor a petition bearing the signatures of at least a majority of the members of each house and requesting a special session of the legislature only for the purpose of resolving the budget deficit. The petition shall designate the date of convening. On receipt of the petition, the governor shall promptly call a special session to assemble on the date specified only for the purpose of resolving the budget deficit.

D. The legislature shall enact laws and adopt rules to carry out this section.  CONST

2. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
