HOUSE BILL 2250

 

 

 

AN ACT

 

amending title 49, chapter 3, article 1, Arizona Revised Statutes, by adding section 49-414; relating to air quality.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 49, chapter 3, article 1, Arizona Revised Statutes, is amended by adding section 49-414, to read:

START_STATUTE49-414.  All hazards generator; emissions exemption; standard

A.  Notwithstanding any other law, a generator and its related pumps, equipment and systems that are certified for compliance with the united states department of defense specification MIL-STD-188-125-1 in effect on January 1, 2017 are exempt from state and county air quality emissions standards.

B.  If required for compliance with the clean air act, the department shall request from the United States environmental protection agency an exemption from the clean air act provisions that regulate emissions caused by the use and operation of generators that are certified as prescribed by subsection A of this section. Sec. 2.  Conditional enactment; notice

A.  Section 49-414, Arizona Revised Statutes, as added by this act, does not become effective unless on or before July 1, 2018 the United States environmental protection agency approves the proposed modifications to state and county air quality emissions standards as part of the state implementation plan for air quality.

B.  The director of the department of environmental quality shall notify in writing the director of the Arizona legislative council on or before October 1, 2018 either:

1.  Of the date on which the condition was met.

2.  That the condition was not met.
