An Act

 

amending title 36, chapter 4, article 7, Arizona Revised Statutes, by adding section 36-447.03; relating to nursing care institutions.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 36, chapter 4, article 7, Arizona Revised Statutes, is amended by adding section 36-447.03, to read:

START_STATUTE36-447.03. Medical directors; certification required; notification

A. A medical director of a nursing care institution shall be certified as a medical director by the American board of post-acute and long-term care medicine or an equivalent organization as specified by the department. If a nursing care institution hires or contracts with a medical director who is not a certified medical director, the medical director shall become certified within five years after the date of the contract or initial hire.

B. A medical director of a nursing care institution who is employed or contracted on or before January 1, 2024 must become a certified medical director as required by subsection A of this section on or before January 1, 2029.

C. A nursing care institution shall submit to the director of the department on the initial hire of or contract with a medical director all of the following information:

1. The medical director's resume.

2. The medical director's certification status.

3. If not yet certified as required by subsection A of this section, the medical director's expected date of certification.

D. A nursing care institution shall notify the department of any changes in its medical director within ten calendar days after the change and shall submit the information required by subsection C of this section for the new medical director.

E. On or before November 1, 2024, all nursing care institutions shall provide to the department the resume and proof of certification or progress toward certification of the nursing care institution's medical director. END_STATUTE
