HOUSE BILL 2088

 

 

AN ACT

 

Repealing title 8, chapter 3, article 5, Arizona Revised Statutes; transferring title 8, chapter 3, article 5.1, Arizona Revised Statutes, for placement in title 8, chapter 3, Arizona Revised Statutes, as a new article 5; transferring and renumbering sections 8-368 and 8-368.01, Arizona Revised Statutes, for placement in title 8, chapter 3, article 5, Arizona Revised Statutes, as sections 8-361 and 8-362, respectively; amending section 8-362, Arizona Revised Statutes, as transferred and renumbered by this act; amending title 8, chapter 3, article 5, Arizona Revised Statutes, as transferred and renumbered by this act, by adding sections 8-363, 8-364 and 8-365; relating to the interstate compact for juveniles.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Repeal

Title 8, chapter 3, article 5, Arizona Revised Statutes, is repealed.

Sec. 2.  Transfer and renumber

Title 8, chapter 3, article 5.1, Arizona Revised Statutes, is transferred for placement in title 8, chapter 3, Arizona Revised Statutes, as a new article 5.  Sections 8-368 and 8-368.01, Arizona Revised Statutes, are transferred and renumbered for placement in title 8, chapter 3, article 5, Arizona Revised Statutes, as sections 8-361 and 8-362, respectively.

Sec. 3.  Section 8-362, Arizona Revised Statutes, as transferred and renumbered by this act, is amended to read:

START_STATUTE8-362.  Commission assessments

The department of juvenile corrections shall pay the assessment that is levied each year by the interstate commission for juveniles pursuant to section 8‑368 8-361. END_STATUTE

Sec. 4.  Title 8, chapter 3, article 5, Arizona Revised Statutes, as transferred and renumbered by this act, is amended by adding sections 8-363, 8-364 and 8-365, to read:

START_STATUTE8-363.  Juvenile compact administrator, compact commissioner; authority to appoint deputy compact administrator; state council

Pursuant to the compact, the governor shall:

1.  Designate the director of the department of juvenile corrections as the state's interstate compact commissioner and compact administrator.   the director of the department of juvenile corrections, acting As the state's interstate compact commissioner and compact administrator, has the authority to appoint and delegate duties to an interstate deputy compact administrator, including the duty to act as this state's voting representative on the interstate commission for juveniles.  The compact administrator, compact commissioner and deputy compact administrator shall cooperate with all departments, agencies and officers of and in the government of this state and its subdivisions in facilitating the proper administration of the compact. 

2.  create a state council and determine its membership in compliance with section 8-361, article IX.  END_STATUTE

START_STATUTE8-364.  Financial arrangements

The compact administrator, subject to the approval of the director of the department of administration, may make or arrange for any payments necessary to discharge any financial obligations imposed on this state by the compact or by any supplementary agreement entered into under the compact. START_STATUTE8-365.  Responsibilities of state departments, agencies and officers

The courts, departments, agencies and officers of this state and its subdivisions shall enforce this compact and shall do all things appropriate to the effectuation of its purposes and intent that may be within their respective jurisdictions. END_STATUTE
