AN ACT

 

amending title 44, chapter 9, Arizona Revised Statutes, by adding article 23; relating to high‑volume internet sellers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 44, chapter 9, Arizona Revised Statutes, is amended by adding article 23, to read:

ARTICLE 23.  HIGH-VOLUME INTERNET SELLERS

START_STATUTE44-1379.  Definition of high-volume internet seller

In this article, unless the context otherwise requires, "high‑volume internet seller" means a seller on an internet marketplace who in the previous twelve month period has made or offered to make discrete transactions aggregating to at least twelve thousand dollars.END_STATUTE

START_STATUTE44-1379.01.  Requirements

An operator of an internet marketplace must do all of the following:

1.  Require the seller of property whose merchandise packaging identifies the property as being available from a particular or exclusive retail source to post the identifying information conspicuously on the internet website where other information about the property is posted.

2.  For each high‑volume internet seller, Maintain the following information for at least three years:

(a)  The name, the telephone number, the e-mail address, the legitimate physical address, any user identification and the company name of the high‑volume internet seller.

(b)  The details of all transactions conducted by each high‑volume internet seller on the internet marketplace for the most recent three year period.

3.  Require a high‑volume internet seller to do either of the following:

(a)  Conspicuously post its name, telephone number and legitimate physical address on the internet website where other information about the property being sold by the high‑volume internet seller is posted.

(b)  On request of any business that has a reasonable suspicion that goods or services at the site were acquired through organized retail crime, provide its name, telephone number and legitimate physical address.END_STATUTE
