Strike everything after the enacting clause and insert:
"Section 1. Title 38, chapter 8, Arizona Revised Statutes, is amended by adding article 3, to read:
ARTICLE 3. PEACE OFFICER POSITIONS
38-1161. Peace officer positions; reclassification; prohibited; exception; definition
A. beginning January 1, 2021, A city or town may not:
1. Reclassify an employee position that is filled by a certified peace officer as an employee position that a person who is not a certified peace officer would be eligible to hold.
2. Reclassify a full-time employee position that only a certified peace officer is eligible to hold as a part-time or reserve position.
3. Transfer an employee responsibility or duty that is being performed by a certified peace officer to an employee who is not a certified peace officer.
B. Subsection A of this section does not apply to vacant positions.
C. For the purposes of this section, "certified peace officer" means a peace officer who is certified by the Arizona peace officer standards and training board.
Sec. 2. Retroactivity
This act applies retroactively to from and after December 31, 2020."
Amend title to conform
