HOUSE OF REPRESENTATIVES AMENDMENTS TO H.B. 2310

Strike everything after the enacting clause and insert:

"Section 1. Title 38, chapter 8, Arizona Revised Statutes, is amended by adding article 3, to read:

ARTICLE 3. PEACE OFFICER POSITIONS

START_STATUTE38-1161. Peace officer positions; reclassification;   prohibited; exception; definition

A. beginning January 1, 2021, A city or town may not:

1. Reclassify an employee position that is filled by a certified peace officer as an employee position that a person who is not a certified peace officer would be eligible to hold.

2. Reclassify a full-time employee position that only a certified peace officer is eligible to hold as a part-time or reserve position.

3. Transfer an employee responsibility or duty that is being performed by a certified peace officer to an employee who is not a certified peace officer.

B. Subsection A of this section does not apply to vacant positions.

C. For the purposes of this section, "certified peace officer" means a peace officer who is certified by the Arizona peace officer standards and training board. END_STATUTE

Sec. 2. Retroactivity

This act applies retroactively to from and after December 31, 2020."
