HOUSE RESOLUTION 22

Supporting the Medal of Valor nomination of West Virginia State Police Corporal Marshall Lee Bailey as recommended by the First Responders Honor Board.

Whereas, The Medal of Valor is awarded to firefighters, law-enforcement officers, and emergency medical services personnel who distinguish themselves conspicuously by gallantry and intrepidity at the risk of their lives above and beyond the call of duty in the performance of their duties; and

Whereas, The First Responders Honor Board has submitted the Speaker of the House of Delegates the following nominee for the Legislature’s consideration:

Corporal Marshall Lee Bailey of the West Virginia State Police; and

Whereas, Marshall Lee Bailey was born June 24, 1970, the son of Maxie Lee and Earlene Gail McClanahan Bailey of Poca, West Virginia; and

Whereas, Marshall Lee Bailey graduated from Poca High School in 1988, where he participated in football, basketball and track; and

Whereas, Marshall Lee Bailey graduated from West Virginia State University with a Bachelor of Science Degree in Criminal Justice; and realized his childhood ambition of graduating from the West Virginia State Police Academy on March 29, 1996, was promoted to Senior Trooper in October of 1998, was promoted to Trooper 1st Class in October of 2003 and was promoted to the rank of Corporal in October, 2004; and

Whereas, Corporal Marshall Lee Bailey enjoyed protecting the citizens of West Virginia and was proud to wear the uniform of a West Virginia State Trooper, serving almost his entire career among the people of Clay County, whom he came to love; and

Whereas, Corporal Marshall Lee Bailey had compiled a long and distinguished record of service as a West Virginia State Trooper; and

Whereas, on the evening of August 28, 2012, Corporal Marshall Lee Bailey initiated a traffic stop for reckless driving at the Wallback interchange of Interstate 79 in Clay County near the Roane County line; and

Whereas, Corporal Marshall Lee Bailey was soon joined on the scene by another West Virginia State Trooper; Eric Workman; and

Whereas, using the skills and training in investigative techniques cultivated in his career, Corporal Marshall Lee Bailey, with Trooper Eric Workman, was able to discern the suspect was operating a stolen vehicle; and

Whereas, Corporal Marshall Lee Bailey and Trooper Eric Workman effectuated an arrest of the suspect; and

Whereas, the suspect in the course of that arrest produced a handgun and cruelly gunned down both Corporal Marshall Lee Bailey and Trooper Eric Workman, immediately killing Corporal Marshall Lee Bailey, and mortally wounding Trooper Eric Workman; and

Whereas, the career of Corporal Marshall Lee Bailey as a West Virginia State Trooper, and his dedication and service in upholding the rule of law in our state is worthy of the utmost respect and emulation; and

Whereas, Corporal Marshall Lee Bailey’s gallant and intrepid actions in the line of duty and his willingness to go beyond the call of duty and lay down his life for the people of West Virginia deserve the utmost respect; and

Whereas, Corporal Marshall Lee Bailey’s courage in the face of great danger and unwavering dedication to duty reflect great credit upon himself and to all who serve as a West Virginia State Trooper; and

Whereas, The House of Delegates is honored to support the nomination of deserving heroes for the Medal of Valor and is eternally grateful for their service and sacrifice; therefore, be it

Resolved by the House of Delegates:

That the House of Delegates hereby supports the nomination of Corporal Marshall Lee Bailey for the award of the Medal of Valor as recommended by the First Responders Honor Board; and, be it

Further Resolved, That the Governor shall bestow the Medal of Valor upon Corporal Marshall Lee Bailey, posthumously, upon adoption of this resolution; and, be it

Further Resolved, That the Clerk of the House shall forward a copy of this resolution to the surviving family of Corporal Marshall Lee Bailey.
