A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §17A-6A-19, relating to requiring used vehicle dealers to provide vehicle history reports to prospective buyers of formerly recalled vehicles.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §17A-6A-19, to read as follows:
ARTICLE 6A. MOTOR VEHICLE DEALERS, DISTRIBUTORS, WHOLESALERS AND MANUFACTURERS.
§17A-6A-19. Vehicle history reports for recalled vehicles.
Except when waived in writing by an interested potential purchaser, a dealer of used motor vehicles may not fail to provide a vehicle history report from a reputable source, such as Carfax or a similar service, to any interested potential purchaser on any used vehicle which has been the subject of a manufacturer’s recall.
NOTE: The purpose of this bill is to provide that used car dealers must provide vehicle history reports to persons interested in a used vehicle which has been the subject of a manufacturer’s recall.
