A BILL to amend the Code
of West Virginia, 1931, as amended, by adding thereto a new article, designated
§5-11B-1, relating to providing certain notice to civil service exempt
employees dismissed from employment due to change in administration.
Be it enacted by the
Legislature of West Virginia:
That the Code of West
Virginia, 1931, as amended by amended by adding thereto a new article,
designated §5-11B-1, to read as follows:
article 11B. Public policy
requiring notice to certain dismissed employees.
§5-11B-1. Public policy declared; notice required.
It is the
public policy of this state that any civil service exempt, at-will employee of
the state or its political subdivisions, dismissed from employment due to
change in administration, be provided with not less than a two-day notice of
dismissal and not less than a period of two days allotted for the employee to vacate
his or her office.
NOTE: The purpose of this bill is
to provide to any at-will, civil service exempt employee, dismissed from a job
due to a change in administration, a minimum notice and time to vacate his or
her office.
