Summary
The purpose of this bill is to delete language allowing a county commission to reimburse a mental health care facility for security services for the period of time a person is at the hospital prior to the determination of mental competence or incompetence. The bill further provides that the President of the West Virginia Sheriffs' Association, along with the Supreme Court of Appeals and the Secretary of the Department of Health and Human Resources shall develop and propose a statewide system for evaluation and adjudication of mental hygiene petitions. The bill further provides that the Department of Health and Human Resources shall reimburse the county commission for direct deposit into the Sheriff's budget all other expenses incurred in the hearings conducted under the provisions of the article.
