The purpose of this bill is to clarify that a licensed pharmacy is a health care facility and licensed pharmacies and pharmacists are health care providers solely under the provisions of the Medical Professional Liability Act. Licensed pharmacies and pharmacists are licensed and certified by the West Virginia Board of Pharmacy and participate in the preparation, compounding and dispensing of drugs and medical devices to patients that are used in the diagnosis, treatment, and prevention of disease.
