AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the House Committee on Appropriations
on February 9, 2022)

A BILL to require the Department of Social Services to submit a request for a waiver to allow individuals in the custody of state or local correctional facilities to apply for SNAP benefits prior to release.

Be it enacted by the General Assembly of Virginia:

1. §1. That the Department of Social Services (the Department) shall submit to the U.S. Department of Agriculture a request to waive the provisions of 7 C.F.R. §273.1(b)(7)(vi) to allow individuals in the custody of state or local correctional facilities in the Commonwealth to apply for SNAP benefits prior to release from custody and, upon approval of such waiver, shall (i) implement a process by which individuals in the custody of state or local correctional facilities may apply for SNAP benefits prior to release from custody and (ii) distribute to the Department of Corrections and the State Board of Local and Regional Jails information regarding such process.
