A BILL to amend the Code of Virginia by adding sections numbered 28.2-204.2 and 29.1-318.1, relating to establishing a special species catch license.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 28.2-204.2 and 29.1-318.1 as follows:

§28.2-204.2. Special species catch license established; Commission to adopt regulations.

A. The Commission shall adopt regulations establishing a special species catch license that shall be issued to persons to catch or take a specific species of fish when it finds that such species (i) are a threat to the viability of other tidal water fisheries or (ii) may have a significant ecological or economic impact. The regulations shall specify the following:

1. The type of gear that shall be used;

2. Length of season or time period for which license is valid;

3. Tidal waters where such fishing is authorized; and

4. Daily catch limit.

B. The holder of such a license is authorized to commercially sell his catch.

C. The costs of the license shall not exceed the costs of issuing the license.

§29.1-318.1. Special species catch license established; Board to adopt regulations.

A. The Board shall adopt regulations establishing a special species catch license that shall be issued to persons to catch or take a specific species of fish when it finds that such species (i) are a threat to the viability of other freshwater fisheries or (ii) may have a significant ecological or economic impact. The regulations shall specify the following:

1. The type of gear that shall be used;

2. Length of season or time period for which license is valid;

3. Inland waters where such fishing is authorized; and

4. Daily catch limit.

B. The holder of such a license is authorized to commercially sell his catch.

C. The costs of the license shall not exceed the costs of issuing the license.
