relating to an emergency rule adopted by a state agency during | ||
certain periods of disaster. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 2001.034, Government Code, is amended by | ||
amending Subsection (c) and adding Subsection (c-1) to read as | ||
follows: | ||
(c) Except as provided by Subsection (c-1), a [ |
||
adopted under this section may be effective for not longer than 120 | ||
days and may be renewed once for not longer than 60 days. An | ||
identical rule may be adopted under Sections 2001.023 and 2001.029. | ||
(c-1) This subsection applies only to an emergency rule | ||
adopted during a period in which at least 75 percent of the counties | ||
in this state are declared to be in a state of disaster or emergency | ||
by the governor. An emergency rule to which this subsection applies | ||
may be effective for not longer than 30 days and may be renewed for | ||
not longer than 60 days. The renewal must be approved by majority | ||
vote at a joint hearing of the standing committees of each house of | ||
the legislature with primary jurisdiction over the state agency | ||
seeking to renew the emergency rule. | ||
SECTION 2. Section 2001.034(c-1), Government Code, as added | ||
by this Act, applies only to an emergency rule that is adopted by a | ||
state agency on or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2021. |
