A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to an emergency rule adopted by a state agency during |
|
certain periods of disaster. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 2001.034, Government Code, is amended by |
|
amending Subsection (c) and adding Subsection (c-1) to read as |
|
follows: |
|
(c) Except as provided by Subsection (c-1), a [A] rule |
|
adopted under this section may be effective for not longer than 120 |
|
days and may be renewed once for not longer than 60 days. An |
|
identical rule may be adopted under Sections 2001.023 and 2001.029. |
|
(c-1) This subsection applies only to an emergency rule |
|
adopted during a period in which at least 75 percent of the counties |
|
in this state are declared to be in a state of disaster or emergency |
|
by the governor. An emergency rule to which this subsection applies |
|
may be effective for not longer than 30 days and may be renewed for |
|
not longer than 60 days. The renewal must be approved by majority |
|
vote at a joint hearing of the standing committees of each house of |
|
the legislature with primary jurisdiction over the state agency |
|
seeking to renew the emergency rule. |
|
SECTION 2. Section 2001.034(c-1), Government Code, as added |
|
by this Act, applies only to an emergency rule that is adopted by a |
|
state agency on or after the effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2021. |
