relating to requiring public schools to make reasonable | ||
accommodations for lactating students. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 38, Education Code, is | ||
amended by adding Section 38.041 to read as follows: | ||
Sec. 38.041. ACCOMMODATIONS FOR LACTATING STUDENTS. The | ||
board of trustees of each school district, the governing boards of | ||
the Texas School for the Blind and Visually Impaired and the Texas | ||
School for the Deaf, and the governing body of each open-enrollment | ||
charter school shall provide reasonable accommodations to a | ||
lactating student enrolled at the middle or high school level to | ||
enable the student to: | ||
(1) express breast milk; | ||
(2) breast-feed an infant child; and | ||
(3) address other needs related to breast-feeding. | ||
SECTION 2. This Act applies beginning with the 2023-2024 | ||
school year. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
