A BILL TO BE ENTITLED
 
AN ACT
  relating to requiring public schools to make reasonable
  accommodations for lactating students.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 38, Education Code, is
  amended by adding Section 38.041 to read as follows:
         Sec. 38.041.  ACCOMMODATIONS FOR LACTATING STUDENTS. The
  board of trustees of each school district, the governing boards of
  the Texas School for the Blind and Visually Impaired and the Texas
  School for the Deaf, and the governing body of each open-enrollment
  charter school shall provide reasonable accommodations to a
  lactating student enrolled at the middle or high school level to
  enable the student to:
               (1)  express breast milk;
               (2)  breast-feed an infant child; and
               (3)  address other needs related to breast-feeding.
         SECTION 2.  This Act applies beginning with the 2023-2024
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
