BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 48.102, Education Code, is amended to | ||
add Subsection (a-1) to read as follows: | ||
(a-1) To address the extraordinary gap in school district | ||
expenses for special education, a school district with two prior | ||
consecutive years of expenditures for students with disabilities | ||
that exceed the amount of the allotment under this section received | ||
in those years is entitled to additional funding in an amount that | ||
would compensate the district for the amount of the difference in | ||
funding. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
