relating to the authority of certain counties to cancel platted | ||
subdivisions that have remained undeveloped. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 232.0085, Local Government Code, is | ||
amended by amending Subsection (a) and adding Subsection (g) to | ||
read as follows: | ||
(a) This section applies only to real property that | ||

(1) is located [ |

||
county, as defined by Section 16.341, Water Code, that: | ||
(A) has adopted the model rules developed under | ||
Section 16.343, Water Code;[ |
||
(B) is located along an international border; and | ||
(2) if the area is located in the extraterritorial | ||
jurisdiction of a municipality, is not subject to a written | ||
agreement under Section 242.001 that authorizes the municipality to | ||
regulate subdivision plats and approve related permits in the | ||
extraterritorial jurisdiction. | ||
(g) Notwithstanding Section 232.0015(b) or any other law, | ||
this section applies to a subdivision of land to which Subchapter B | ||
applies. | ||
SECTION 2. This Act takes effect September 1, 2021. |
