A BILL TO BE ENTITLED
 
AN ACT
  relating to requirements to meet national ambient air quality
  standards.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 382, Health and Safety
  Code, is amended by adding Section 382.0174 to read as follows:
         Sec. 382.0174.  NATIONAL AMBIENT AIR QUALITY STANDARD
  COMPLIANCE. The commission may not require a person who applies for
  a permit or authorization under this chapter to demonstrate that
  the activity to be permitted or authorized complies with a national
  ambient air quality standard unless the demonstration is required
  by:
               (1)  Section 165(a)(3) of the federal Clean Air Act (42
  U.S.C. Section 7475(a)(3)); or
               (2)  the state implementation plan adopted under
  Section 382.0173.
         SECTION 2.  This Act takes effect September 1, 2011.
