| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 382, Health and Safety | ||
| Code, is amended by adding Section 382.0174 to read as follows: | ||
| Sec. 382.0174. NATIONAL AMBIENT AIR QUALITY STANDARD | ||
| COMPLIANCE. The commission may not require a person who applies for | ||
| a permit or authorization under this chapter to demonstrate that | ||
| the activity to be permitted or authorized complies with a national | ||
| ambient air quality standard unless the demonstration is required | ||
| by: | ||
| (1) Section 165(a)(3) of the federal Clean Air Act (42 | ||
| U.S.C. Section 7475(a)(3)); or | ||
| (2) the state implementation plan adopted under | ||
| Section 382.0173. | ||
| SECTION 2. This Act takes effect September 1, 2011. | ||
