relating to the provision of certain prescription medications to a | ||
foster child. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 226, Family Code, is | ||
amended by adding Section 266.0042 to read as follows: | ||
Sec. 266.0042. PRESCRIPTION MEDICATION REQUIREMENTS. (a) | ||
Except in the case of an emergency, a foster child may not be | ||
prescribed more than four prescription medications to be taken | ||
concurrently unless the decision to prescribe the medications is | ||
reviewed and approved by an independent physician provided by the | ||
managed care organization providing health care services to the | ||
child under the STAR Health program. | ||
(b) The department shall maintain a record of all | ||
medications prescribed for a child in the conservatorship of the | ||
department. The record must include, for each medication, the name | ||
of the medication, the dosage amount, and the frequency with which | ||
the child is to receive the medication. | ||
SECTION 2. This Act takes effect September 1, 2011. |
