relating to administrative penalties assessed or imposed against | ||
certain hospitals and reported to certain health professional | ||
licensing boards. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 241.059, Health and Safety Code, is | ||
amended by adding Subsection (i-1) to read as follows: | ||
(i-1) Not later than the 30th day after the date the | ||
commissioner of health's order is final, the department shall | ||
forward a copy of the order to the appropriate licensing board of a | ||
health care professional licensed under Title 3, Occupations Code, | ||
who the commissioner finds to be materially involved in the | ||
violation. The licensing board shall retain a copy of the order in | ||
the health care professional's file. The copy of the order is | ||
confidential to the extent required by law. | ||
SECTION 2. The change in law made by this Act applies only | ||
to the assessment or imposition of an administrative penalty under | ||
Section 241.059, Health and Safety Code, for a violation that | ||
occurs on or after the effective date of this Act. The assessment | ||
or imposition of an administrative penalty under Section 241.059, | ||
Health and Safety Code, for a violation that occurs before the | ||
effective date of this Act is governed by the law in effect on the | ||
date the violation occurred, and that law is continued in effect for | ||
that purpose. | ||
SECTION 3. This Act takes effect September 1, 2013. |
